I met my fiance over 5 years ago and we had a daughter born here in Mexico in 2006. We submited all this information with the I-129F. We also registered her at the US embassy and she now has a US passport. I´ve never entered the US illegaly and I have always had a tourist visa, I was even granted a new one a month ago (and I told the truth).

Questions:

Do you think there´s any chance of me not getting aproved?

Does my daughter have to go throgh any further process or can she go straight to the US?

Im not a expert but ur daughter should already be usa citizen so she should not have to go thru anything at all.........as far as will it hurt ur case no.....i dont think so......sure shows that u have a relationship.........and the fact that u told the truth should bring more weight to ur case :thumbs: good luck and may ur journey be swift and problem free

Have you seen you fiance in person within the last two years? If not, you will be denied and need to file again after seeing each other in person again.

There are procedures to follow to get a US passport for the natural child of a US Citizen.

Facts are cheap...knowing how to use them is precious...

Go to the US consulate in Mexico (or call) and they can give you the papers necessary for your daughter to get US passport.

Then your daughter will be able to travel to america with no problem.

From what you say, your visa should be easy to get because you can prove you have relationship easily.

As pushbk says though. Make sure your husband comes to visit you often, and take pictures in places where date is obvious.

In bank that has date and location on wall.

Get newspaper with date visible and hold in picture with you both in the picture.

Anything like this to prove you are together.

For this though, really the BEST proof is if he comes to the interview with you.

Then, they can not argue, you have proof he is standing beside you :).

The only other possible problem might be finances. Make sure the US citizen makes more than 125% of the poverty level for a family of 3 (counting your daughter).

Also, he must have a place for you to live in America, so get proof of a lease, or utility bills, etc. that show where he lives in USA.

I think I didn´t write clearly and I will explain better. Sorry.

We met over 5 years ago, he came back and forth to visit me then I got pregnant and she was born on feb of 2006.

He came down for her Birth (we have pics)

He came once on Xmas of 2006 (we have pics of them together)

He came on her Bday (also have pics)

Then he came back last August to get her paperwork done: We managed to register here in Mexico, we spent Xmas together (we have pics) and we registered our daughter at the US consulate in Mexico City (she recieved her US passport in March).

I got a tourist visa a month ago and the interviewer that grants them knew I am trying to see her father... Before she granted it she said "you know you can´t stay with this visa right?" I said "Yes, I have to come back for the Ciudad Juares interview anyway" And she said "Okay, your visa is granted"

But now I´m not sure if I should go as a tourist because I´m afraid they are going to tell me I can only stay for 15 days or something like that and we can´t be spending on two flights going back and forth because my baby has to stay with me... So I was thinking maybe I can go up once we know exaclty when I get the CDJ apointment? But maybe they would deny me entry because my name comes up or something... I miss him... She misses her Daddy so much.... They really bonded these six months he was here.

Looks like all is in order for the K1 but you are wise to be concerned about a denied entry. It won't impact your K1 visa but would be a waste of time and money. What could you bring to show ties to Mexico?

Well, I have property here in Mexico and I´m still running my internet advertisement business. Is this what you mean?

So my name wouldn´t be flagged?

How long could they let me stay as a tourist?

The thing is that after those 6 months of being here he kind of lost his job, so we decided to change cities he used to be in Florida and he went back up to start all over in Las Vegas. He´s doing well, he has a job but he is shareing a house with other people since rent is chaper this way. If I head up there he has to look for an apartment since I can´t live in the shared house, so if I head up and they don´t let me stay then he would have left a good living arragement and be stuck with an apartment by himself until I get there.

So does anyone think they will let me stay for around 2 months or so? Until my apointment comes through.

It would also be easyer because I´m afraid of taking my baby to CDJ all by myself, I´ve heard some bad things about that place and my daughter is a bit hard to control. lol

Having property and a business in Mexico is a good way to show ties to your country; however they won't have that information in your system, so when you go to cross the border take as much physical evidence - that is, papers, etc. - as you can.

Hi Arianna,

if you enter US now, you have an US citizen with you. You are bringing that citizen to see her dad. I really doubt they will deny you entry! (Never had problems with bringing my son (and me) to see his dad and I did that with staying in US out of 24 month probably 18, but with leaving US in between. I had a B1/B2 at that time.)

If they ask more (which I doubt!), then you can say, that you are staying for about 3 months or whatever your flight ticket shows.

You are in a different situation having a US citizen with you!

The meeting requirement relates to the filing date. At interview, you'll need to demonstrate an ongoing bona fide relationship. That might be somewhat more difficult if you haven't been together in over two years but it is an entirely separate and different issue.

Just wanted to say that pictures are NOT evidence you have met in the last 2 years. You need to provide passport stamps, hotel receipts, airline boarding passes etc. The pictures help, but will not be sufficient alone. As Pushbrk added, the requirement for meeting is at time of submission of the packet, NOT at the interview. It will help with continuing relationship IF they let the USC attend the interview.
