Cancel K1 Visa

I know I'm not exactly a regular contributor here, but this past year has been a very tumultuous one in my journey to get my fiance a K1 Visa. The process itself has gone very smoothly, more so than I could have anticipated, but the relationship itself was not equally so. At different times we almost broke up, and finally we did--at a late stage in the process. Which leds to my question about cancelling a K1 Visa. I have done research on the net and have come up witll all sorts of various info--but nothing that I feel exactly answers my question.

Since the case is now being processed in the foreign country consulate (China specifically), who do I need to contact to cancel the application--there (foreign consulate) or here in the USA where the application was first sent (California). I have read that the Visa will automatically expire in 1 year--or 2 years? Got different numbers on that---and if either is true--from what point does that time figure (time of application, or time of interview?).

I would greatly appreciate if anyone can tell me so I can get this over with and put the whole affair behind me. I know many people here and other places say the long wait to get the Visa is hard--but I think it can be a good thing--to a point. Gives you a chance to "be sure." My two cents anyway.

I don't have the answer to your question, sorry. But, I think you are right to cancel the paperwork instead of letting it expire. Hopefully, you will meet someone else soon and if you decide to start the process again, it will be important that the previous K1 visa has been terminated.

Hopefully, someone else knows how to submit the cancellation request.

If your petition is at the consulate I would e-mail them to let them know that you want to cancel your petition and I would also send a letter (signed and notarized) to the consulate.

Thanks for the suggestions. I think I will send letters (and email) to both the processing center here, and the consulate--just to cover all basis. I just don't want to have anything "left hanging open." Of course I realize if I did file again, I'd be put in some database, but I don't care about that just so I don't hit any undesireable snags--should I choose to go down the route again. ^^''

I've been searching for an answer to my question and thought this thread might be an appropriate place to ask. Does a prior cancelled K-1 (for fiance abroad) effect the outcome of a visa with me now? It would have been cancelled for at least a year I believe. Are there any provisions I can read about regarding this? Thanks!

You have to submit a waiver request with the I-129F if you have submitted another I-129F application within the previous 2 years.

I agree with this. Reason being, I have heard of the visa being approved at the late stage.....if all the paperwork prior was sent in and all that....and of the fiance coming to the US anyhow. If you want it stopped, you really need to make sure proper channels are followed and it is stopped.

What do you mean she has? The restriction is on the petitioner and only a US citizen can file a petition...

I'm sorry, I'm still not familiar with all the nuances of this process. I wasn't sure if she would be on record as being a beneficiary of another USC in the past, even if it was cancelled. I have never filed a petition before. So there's no worries then? There will be no record of this that could effect us? I'm still new to this and just want to make sure I'm covering my bases. Thank you for your patience.

Yes, of course there's a record of her being the beneficiary of an earlier petition but there is not formal limitation on the number of petitions that can be filed for one foreign beneficiary. Beneficiaries of multiple petitions tend to see greater scrutiny of relationship bona fides, so be prepared for that.

We have over 600 pages (Word doc) of yahoo messages for march alone. haha. Then there's the Skype calls. I'll have plenty of pics with her and her family when I visit within the next few months. You can say that again. Further, if you send her to the interview with 600 pages for each month of the visa process, you're going to have one pissed off lady. You've got time to learn about what evidence to have available and how to most effectively present it. First step is to change your focus from tonnage to effective.

Oh I'm sorry for the confusion regarding proof of relationship, haha. I didn't mean to imply that I count on bringing all this to the interview. I just meant that we will have confidence in knowing that we do have plenty of evidence to back up our love story. We won't require all of this to present our story. I agree with you both that it isn't necessary, nor entirely effective, to bring that amount of material to make a case. Certainly not 600 pages for one month!

I'm not gonna treat the embassy as the big bad boogeyman and beg for mercy. You take it serious, follow the guidelines and you and your fiance/spouse get to be together.
