can you get SSN after marriage

we went today to apply for SSN and the man told us we cant get it cause now i am no longer faince but husband and that i need to get EAD first to get SSN !!!!! and that might take about 4 months to get?is that right? i am so confused

any help

More than whether you are married or not it depends on when you entered the country on your K1. After 74 days or so in the country, they no longer create a SSN number under the k1 visa. Then depending on what they tell you (it varies by states) you need your EAD or Green Card for it.

EAD takes about 90 days.

08.2006: Entered with a B-2 visa.

07.06.07: Civil Wedding

07.17.2008 AOS approved with interview. It took 367 Days!

11.08.08: Big family wedding

09.18.09-10.03.09: First trip to France with Hubby

04.19.10: Package sent to Vermont

i just came to usa 10 days ago so i thought i can get my social security but the man there told me i have to get EAD first to get it since i am no more k1 as he said

You have to wait until you receive your greencard, ead... They need to see proof that of your current immigration status

i applied for my SSN as soon a i arrived in the US, and after the marriage i wanted to change my name but they told me that i have to come back with proof of my status... i even brought my NOA 1 from my EAD/AOS but it wasnt sufficient.

You should have applied for you SSN before the marriage. Now you'll have to wait until you receive your Greencard/Work authorization

my husband got his SSN after we got married and before we filed AOS with no problem. all he needed was his I-94.

we married 4 days after he arrived, and he applied for his SSN a week and a half later, and we received it in the mail 2 weeks after that. We filed AOS paperwork after he received his card.

search other threads on this - it is widely discussed (my comp. is slow and i'm having trouble or i'd try to find them). But it is not uncommon for employees at the SS offices to not know their own rules. But, you need to be in the system, which takes about 2 weeks after you arrive. maybe that's the problem - ? I know it's important to wait 2 weeks after your arrival before you apply, and also not to wait until your I-94 is about to expire. Check the FAQs and how to apply for SSN in the guides - it gives advice and examples of what to bring with you when you apply.

You should have applied for you SSN before the marriage. Now you'll have to wait until you receive your Greencard/Work authorization

That is simply not true, not for K1s. See the document in my signature. They also should not have required you to show proof of immigration status for a simple name change. Obviously the people in your local SSA office don't know what they're doing.

You do need to wait at least 10 days after entry before applying so that they can confirm your immigration status. It is probably best to have applied for it before your marriage - but only because their own rules seem to confuse them. :)

But since you are now married, I'd go apply for it anyway, and print out the document in my signature. There is 'no reason you cannot have your SSN as a K1 after your marriage. The fact that they often times don't know (or don't understand) their own rules isn't your problem!

This was my experience. They didn't want to give my husband his social security number either. Said he didn't qualify. I had that memo printed showing he did and gently nudged them to check it, see if it was current or had changed. After waiting another 30 minutes while they called around to find out for sure....he was able to get it.

When her son Arrived on a K-2 Visa to follow, we went to get his SSN also and all we heard from them again is: “No he needs a EAD to get his SSN”. I read you link, but I dont completely understand it.

This SSA policy section means that they won't give an K2 visa holder an SSN without first seeing an EAD stamp on an I-94 (a)(6) code stamp, or an EAD under category (a)(6).

Just to be clear, only read an SSA policy about your eligibility to receive an SSN number, not about your work authorization. The SSA is not the agency who decides your work authorization, the USCIS is.

I got my SSN a month after getting married, with no problems.

Timeline
Since I assume there is no name change involved, SSA isn't going to know you are married unless you tell on yourself. So another option is to take off the ring and try another SSA office and keep your mouth shut about being married.

i will do that on monday and try to go to another office neer me
