so im a little confused,

im going to move to states around the first of august this year, we set the date for our wedding for october the 19th so thats about 80 days after my arrival ..still within the 90 days limit...BUT ...we have to file for AOS as soon as we get married ..because after the K1 expires (which is after 90 days) i wouldnt be legal anymore ..so that means id have to file AOS right after the wedding..but since im allready going to be in the states on my K1 for about 80 days before we even get married my K1 would expire shortly after our wedding, and the EAD takes up to 90 days so would that mean im illegal in the states for about 90 days??

So now i dont know what to do..can you file AOS before getting married ?? or should i just not worry about it and file right after the wedding

im sorry if this sounds confusing ..it sure does to me ..i hope someone can help me!

The most important to get married within 90 days of your arrival to US, AOS you can send later, doesn't matter, just the longer you wait not sending it the longer it will take for you to get EAD/AP and AOS get approved.

K-1 Visa journey:

January '04: met in the USA

21st June '07: sent the I-129

06th November '07 - APPROVED, FINALLY !!!

19th December '07:Medical

20th December '07: Interview Date

21st December '07: VISA IN HAND

18th January '08: Leaving to US !

12th February '08: received SSN

14th March '08: WEDDING DATE

AOS journey:

04th April '08: AOS package sent

11th April '08: Notice date on all 3 NOA's (15 April in the mail)

07th May '08: Biometrics (done)

02nd May '08: Driver's license received

09th May '08: AOS transferred to CSC

15th May '08: AOS is pending at CSC (CRIS email)

18th May '08: AOS touched

04th/09th June '08: EAD Card production ordered (CRIS email) (2 e-mails on different days)

04th June '08: AP approved (CRIS email)

10th June '08: AP in the mail

12th June '08: Approval notice for I765 sent (EAD) (CRIS email)

14th June '08: EAD in the mail

17th June '08: 2nd visit to SS Office - changed my last name on the card

18th/19th June '08: AOS touched

28th June '08: SS card received with a new last name (in the mail)

14th August '08: GC ORDERED (Cris email) !!!

19th August '08: GC and welcoming letter received

Like sunnylight said - the important thing is to get married within 90 days of your arrival. You are not illegal as long as you get married within the time frame of your visa. there's no deadline for when you have to file your AOS. Lots of people wait to file the AOS/EAD/AP. It's expensive, for one thing, and it takes a bit of time to get your application together. That being said, it's probably a good idea to file your AOS and work/travel permit applications as soon as you can so you can work and travel (and who knows when they'll increase the filing fee again...).

Oh, and you can't file your AOS before your wedding - your marriage certificate is a big key to your application. You can, however, try to get as much of the supporting documentation together before-hand just to make the process smoother once you are ready to file.

Until they file for AOS it will actually be out of Status. Pending adjustment will be once the AOS is at the USCIS office.

08.2006: Entered with a B-2 visa.

07.06.07: Civil Wedding

07.17.2008 AOS approved with interview. It took 367 Days!

11.08.08: Big family wedding

09.18.09-10.03.09: First trip to France with Hubby

04.19.10: Package sent to Vermont

04.21.10: Delivered in Vermont

04.22.10: NOA date

04.23.10: Check cashed

05.17.10: Received biometrics appointment letter
