K-1 Visa Vermont mistake has set us back!

Well my fiancée and I are pretty annoyed at the VSC at the moment for a mistake they have made, she has now written to her congressman asking for a bit of help. It all started with us being asked for RFE in the middle of March due to my fiancée accidently entering 2008 instead of 2007 on the G-325A form, which we except was our fault and sorted it out. Our problem is that we did what we were asked to do before the 1st of April (It states in the RFE that if we did it by then we would not encounter much of a delay), however my fiancée then received another letter back the following week stating that they would not except the G-325A form until a payment for $455 was received for the K-1 visa application! We were both astonished because they cashed this cheque when we sent the visa application back in December, so we went and gathered all the evidence showing they had received the money and forwarded it to them using next day delivery on the 1st of April (The day we were originally meant to have sent the RFE). We than waited a while and recieved an e-mail they had received the RFE on the 16th of April! and since then we have been touched on the 21st of April but that is it, nothing since then!!! What we are annoyed about is the fact that it was their mistake when they asked for the payment but they have just treated it as though they had had asked for an RFE delaying the process even more.

We are now worried that we are going to get another RFE due to our case not being looked at since the 21st of April, or maybe our case has been sorted who knows.

Yes; it was their fault and it must be very frustrating for you, but even so they are still within the timeframe for responding to a RFE, which I believe is 60 days. I would not be panicking just yet. Good luck with getting an approval soon.

Yes; it was their fault and it must be very frustrating for you, but even so they are still within the timeframe for responding to a RFE, which I believe is 60 days. I would not be panicking just yet. Good luck with getting an approval soon.

Yes I know it is still within the timeframe but it's still annoying when they have made the mistake and still update the case information as if we had made the mistake. I would have thought that if they had made the mistake they would make every effort to sort it, afterall people who posted after us at the VSC have had their cases completed. Dont get me wrong I am very happy for everyone who have had their cases sorted and I know the statement on the USCIS website 'cases will be sorted in order to be fair' is simply not the case but it is all the more frustrating when they made this mistake.

I know you don't want to hear this.

But you started this process with a mistake on date, and So I would just try to be patient.

I do realise that but it's not the point I'm making (If you notice I do state this in my original post) you would think that when they received the request for further evidence back along with a copy of the original letter they would have realised we had already paid. Our mistake should not have delayed the process this much and it is because of their mistake that it has been.

I had a similar situation. We originally sent our i-129f in June but it was sent back (the whole thing) because we sent the new fee of $455 back then. A border officer told us to send $455 because the fees were going up in July and he thought he was being helpful. He even made a call to his supervisor while we were in his office to make sure he was telling us the correct amount. Well it was wrong. The fee changed end of July (which we knew, but when an officer tells you something different you trust them...just shows how they're all just as confused as us).

Anyway, long story short, his error delayed us. There are no apologies, no special treatment to get you back on track. This is the government. They don't have to worry about customer service. You have no other company to go through. See what I'm saying?

I'm very sorry this happened to you...i'd be frustrated too. But the other posts are correct, don't get too worried yet. Stay on top of it, but don't worry. It'll get done.

One thing to keep in mind: touches don't mean much. Some people get a lot of touches before approval, some (like us) get none. I would not count on touches as an indication on the progress of your case.

Until and unless your petition goes over the processing limits, there is really nothing anyone can do. Response times after receipt of an RFE vary, a few days to a few weeks. And as someone said, they have some time to respond to an RFE.

They asked for another check, that is their mistake, but, the RFE was for the wrong date on the G-325A.

Not had chance to reply for a bit but thanks for your reply. I know I originally put it down as an RFE but it is infact not a request for further evidence as has been pointed out to me. Any way we are still waiting which is driving us both crazy but I think that is probably the idea because only people who are truly in love with each other would go through this! LOL!

Both Service Centers make errors ALL THE TIME and they are way too disorganised to realize when an error has been made. Since you've had an RFE and your case is on a desk why don't you call up again and make sure the money issue is sorted? I wouldn't get upset yet your doing well for time.
