It looks as though we will not get my fiance's renewed Authorization to work will not arrive before his authorization that he received at the POE expires. I didn't do my research early enough and did not file my AOS soon enough... Live and learn I guess..

Is there any way to try to get it expedited? I would hate for him to lose his job permanently because he has to quit for a month or more because he is no longer authorized to work.

Any advice or suggestions? Thanks so much! -SHel

Thanks so much for your reply. -Shel

There is no formal expedite for EADs. I only know of one member who contacted their congressperson to explain the situation to see if it can be rushed through. I have no idea if that actually worked, but she was able to get her EAD a bit quicker than 90 days.

I suggest you made an appointment with the nearest UCSIS office, and ask them directly about it.

Wow! DO mean an actual appointment where I walk into their office? That is not really an option since the nearest is nearly 5 hours away. I called the toll-free number, asking about whether my fiance can continue working.. here is what the woman told me:

Now I called the toll-free line for USCIS and talked to a woman (I took her name and associated ID number)and she said that since I ahve filed the paperwork and have the receipt number that that is the equivalent of an extension of the Temp EAD. At this point in time it is up to the employer whether or not to keep him on. Isn't that interesting? What do you think? Thanks in advance! -Shel

That's what an Immigration Officer told my husband a couple weeks ago. We were instructed NOT to file for a renewal of EAD by two Immigration Officers because his AOS was "going to be decided before then". Yeah...we shouldn't have listened because it's now a week and a half before his 1st EAD expires and his AOS file is still sitting on someone's desk. We filed last Monday, so hopefully he'll get his receipt notice before May 29th. :\

Anyway, she said exactly what this hotline woman said, and what my husband's boss said. (Husband's boss is also an immigrant and used his receipt of renewal as proof of work eligibility. It's...questionable, but his company was fine with it.)
