Warm Greetings to all...

I am just beginning to put my package together to file the I 129F

My Thai fiancee does not have a birth certificate, however she does have a passport.

Can someone give suggestions to what I will need to replace the birth certificate, the birth was never announced,

or can you tell me what my fiancee needs to do under these circumstances

Are there ways around this...?? Any help will be greatly appreciated.

Right, I suspect there's a way to produce one after the fact through an agency of the Thailand government but there are also instructions on what to do about documents that are not available.

I have no idea about Thai laws regarding this matter but in Philippines on this case the last resort was to file for a late registry.

April 06, 2010 - mailed I-751 documents via usps express mail(overnight)with delivery confirmation

April 07, 2010 - packet delivered and signed

April 12, 2010 - check was cashed

April 13, 2010 - received NOA1 (dated 04/08/10)

May 07, 2010 - Biometrics

May 10, 2010 - Touched

June 23, 2010 - APPROVED WITHOUT INTERVIEW!!!

I don't understand how was she able to get a passport without a birth certificate? I don't know how the law works over there... but that is just weird!

Anyway, in every country there is a procedure to register "extemporaneous" births, I suggest your fiance contact the Civil Registrar's office in Thailand (or however the name of the office that registers births is called in her country) and ask about the requirements to follow this procedure, it is usually very simple and it should not take too long.

Did she ever have a birth certificate or did she just lose hers?

Perhaps she got a passport before she misplaced the birth certificate? Who knows.

For what the OP wrote: "the birth was never announced" (registered) I have the impression that the birth certificate never existed.

If it got lost, it really isnt' a big deal, all she would have to do is get a new certified copy.

But it will be better if the OP could clarify that for us.

Yes, The Birth Cirtificate never existed. I think after she acquires the school records from her home town she can get a replacement or register, not sure what you call it.

Thanks for all your replies, I can tell everyone here really stands up for the cause of two people in love being together. I hope I will learn enough to help others along the way as well.

I believe she will need to go to the amphur where she was born. If the birth was never registered, then she will need a relative (preferably her mom or dad) to go with her to the amphur to "attest" to the fact she was born within that region on a given day (she should take her thai passport, thai ID, and tabian baan).

Nothing is straightforward in Thailand - Frequently the first visit to the amphur will result in additional documentation from somewhere being required. Chances are a little baht will get you the BC faster.

Rin was born in Sisaket (about six hours outside Bangkok). Her aunt went to the amphur to get her BC, but they would not give it to her. The following day her uncle went, same last name as Rin, male, 100 baht "extra", BC received. Saved us the trip to Sisaket, so well worth the "service fee".

GREAT NEWS...!!!!

After hearing Aron was needing to go to her home town to get a Birth Certificate a relative was looking through some family papers and found it. That was a big surprise to everyone.

"One Down" and 9,999 to go......... ha ha!!

Thanks to everyone who gave your suggestions and input, hopefully it has or will help other to achieve their goals.
