Hello,

We are past the interview and approval part for AOS but someone asked me a question so I thought posting this would get a fast answer. I know you have to get married within the 90-day limit once the person arrives in the USA but how long would that person have to file their AOS? Is it still the 90-day limit or something different? What happens if the couple doesn't get married? Do they have to leave the USA immediately?

The only reason for get worried is about get married during the 90 days of his/her admision to USA. After that, they can file AOS whenever they want but the K1 holder would be out of status until they file.

If she/he doesn't get married I think she/he must inform to USCIS and go back to your home country. If he/she you doesn't do that he/she can be deported I think.
