Hello all...

We're moving along nicely in the AOS process (see signature for timeline). The biggest step awaits us at our interview in June.

Question:

1. If everything goes well at the interview (which it should - papers in order, married for 3 years with a child and tons of evidence) should we assume that we'll be approved?

2. I know that there's a name check, etc. That said, what is the average time from the interview to actually receiving the GC?

Any educated guesses are appreciated.

Thanks in advance for any help.

It looks good that you will be approved, hopefully your name check is already complete.

After the interview, the green card often comes within 2-3 weeks.

If the name check isn't in, it could take months to years. However, they say that the name check will be a faster process now, so maybe just months. It depends how common your name is and if someone with a criminal history has a name similar to yours.

On the other hand, I've also read that now they wait for the name check to come through before they call you for the interview, so the nc may not be a problem anymore.

Depends. If they do the name check before (which is common now) you passport will be stamped on the day of the interview and there's your Green Card right there! Until you get it in the mail. So you can travel from the day of the interview if you like.

If the name check is done after it could take a while longer but everything is a lot quicker these days. Take your passport the day of the interview, they always request that you do.

Thanks for the info everyone. I'll call USCIS and ask them about the name check.

IsPiKiKaY...what type of RFE if you don't mind me asking? Were you missing a document or what? Hope that's not too personal.

If you completed the paperwork for an Advance Parole document you can exit and re-enter the US prior to the arrival of your greencard.

We were interviewed 4 months after submitting the application for the greencard. The greencard itself did not arrive for another 13 months.

I had my interview last week in Washington, DC. Having a bizzarly unique name as I do, probably helped in the name check arena.

After my approval, the DO stamped my passport with a temporary 1-year I-551 greencard. I didn't even ask. I am sure, if you do get approved on the spot, you can request for that ADIT stamp, if they provide it. After the adjudication, the DO said that the card "...should be in your hands in about two weeks."

Good luck on your journey and interview.

PS: It's worth noting that it would be wise to have an unexpired passport just in case he decides to grace you with that "little dinky stamp that changes lives for the better". As an aside, I'm still amazed at how this little stamp can provide so much. I still stare at it with some semblance of disbelief.

Still waiting for the name check, so who knows! At least with the new rules, we HOPEFULLY won't have to wait years like those before us. There's really no reason for who gets in name checks or not. My husband has a unique name and is from the UK, so who knows why we got stuck. The interviewing officer at our interview said he thought it was mainly those in science professions or from certain countries and was confused why we are stuck. I think they do it for fun ;) Good luck at your interview!!!!

Bottom line: it varies greatly. I wouldn't make any firm plans on traveling until after your interview. Make sure to ask your interviewer if you were approved and, if so, you can have the passport stamp. This stamp will allow you to travel until you get your green card in the mail.
