I am new here. It is a really useful website and I hope some of you can help with my questions about the K1 visa.

(1) Can my fiancee (from Hong Kong) use travel visa to visit and we file the K1 together? Right after, the package is mailed to Hong Kong, my finacee will back to Hong Kong and do the rest. But, we like to work on the form and stuff together. Is it okay if my fiancee stay with me in the US and file the K1 before her travel visa expired?

Thanks!!!!!

Yes, that is what you should do. It will be easier for you to file the I-129F while you are both together in the States so you can sign all the forms together and not have to send them back and forth through the international mail. As long as your fiance doesn´t overstay the tourist visa, and as long as you don´t get married in the US while on the tourist visa and then try to adjust his/her status and stay in the States, you should have no problems. Good luck!!

Yep, my fiance was with me visiting while we filled out the papers too. As long as they are here legally, there's no problem. They can visit periodically too (as long as they can prove strong ties to their home country at the US border) while you wait for your noa2.

Good luck on your journey!

She can stay as long as her visitors visa allows for. She must then go home. If things move slowly she can come back on her visitors visa but she should be ready to show strong ties to home.
