I-130 approved, I-129F still pending

My I-130 was approved on 5/1 but my I-129F is still pending! I'm hoping that it's approved in the next day or two - I was told when I called CIS today that the I-129F was still pending, not closed ...

So, what's the feedback - do I plow through with just the I-130 or do you think the I-129F will go through???

As of now I'm just waiting for the I-129F -- because looking at the processing times it seems like it still saves a lot of time as compared to waiting for the I-130 to be processed at the NVC by itself for "the full permanent resident" thing ...

5/24/10 : I-751 Packet sent to VSC

5/26/10 : Delivered to SAINT ALBANS VT 05479 @ 11:46am

5/27/10 : NOA1 Date (based on scanned check image)

5/28/10 : Funds withdrawn from bank account

6/04/10 : NOA1 (I-797) received, confirming above NOA1 receipt date.

7/31/10 : Biometrics letter received - Appointment date of 8/11/10!

8/11/10 : Biometrics done!

8/29/10 : GC received (sometime last week lol)! (WOW!)

1/15 : I-130 and I-129F sent to Chicago Lockbox

1/17 : Both petitions received @ Chicago

2/27 : Check cashed & I-130 petition visible on system.

5/01 : I-130 APPROVED!!! (But not my I-129F)

5/08 : Got Case # from NVC (received 5/7/08)

5/11 : PAID AOS Fee Online -- I-129F still pending; full speed ahead with I-130!

5/12 : Neetu emailed NVC re: DS-3032 (choice of agent)

5/13 : AOS Status now "PAID" -- AOS PRIORITY MAILED

5/16 : NVC received AOS

5/19 : DS-3032 email accepted & AOS entered in system

5/24 : IV Bill Invoiced and paid online

5/28 : IV Bill status = PAID -- DS-230 EXPRESS MAILED!

5/29 : NVC received DS-230 at 11:01 am

5/30 : DS-230 entered into system

6/03 : CASE COMPLETE - 26 DAYS AFTER NVC RECEIVED I-130

6/10 : Interview scheduled (for 7/9 originally)

6/14 : Interview letter (my copy) received.

6/16 & 6/21 : Medical

7/16 : Interview completed - APPROVED!

7/21 : Neetu picked up passport/brown packet from VFS

7/25 : POE AT EWR!!!

The same exact thing happened to us last week. I called both USCIS and NVC today, but neither had an answer for me besides just wait. :( When did you send your 129? We sent out 130 in Jan. and our 129 in Feb.

Look at the recent developments at NVC though, after they started allowing online payment there.

Check with Loto and the others for more info. But they seem to be moving pretty fast now.

Plus if you filed in Jan and got an I-130 approval already, that's also fast!

I of course don't know the difference in processing time at your Consulate.

Difficult choice, but just waiting for the I-129F, do you want that? You don't know how long that could take.

i just went through the same thing, only my 129 was approved at the same time as my 130.... i did the k3 visa... my attorney said that i was lucky to have them both approved at the same time. this sped my process by about 60 days. if i were to make a bet, i would say that they will approve your 129 in about a month. "patience to you...." is my best advice...

I wouldn't wait for my I-129F to get approved because VSC is at standstill with those petitions and you can't be sure that they whether they are going to approve it or not.I would pursue CR/1 because it's a superior visa and NVC time is much shorter now.I noticed that we have similar timelines and that we also got touched on the same day.My file was touched yesterday also but no sign of an approval yet.I hope that there is no RFE coming!Good luck at NVC!

ur i129f will prob not get approved, vermont service center has a history to not approve i129fs and just approve the i130.. i got approved 2 weeks ago, but my i129f is still pending..

im almost half way thru NVC its going fast.. stick with i130 b/c with online paymetns the NVC time is cut in half now..

dont wait for i129fs, cuz ours did not get approved!

Your I-129F will be processed based on what you put on line 22 of the I-130, per their instructions, if you intended to pursue the I-129F, you must have indicted that on question 22

To ease applicant burden and to avoid any confusion, the Service recommends that petitioners whose alien spouses wish to first obtain a K-3/K-4 visa abroad and later adjust while in the United States so state in Question 21 of Form I-130. Petitioners may state in this question that their beneficiary will apply for adjustment of status in the United States. Petitioners who have previously stated on an approved Form I-130 that the beneficiary would visa process abroad should notify the Service that they now i ntend to apply for a K-3/K-4 nonimmigrant visa and will be applying for adjustment of status to that of lawful permanent resident in the United States. The Service will then request that the Department of State’s National Visa Center (NVC) return the approved Form I-130 to the Service Center with jurisdiction.

Hmmm ... I would think that with online payments that would shave off at least 3-4 weeks of back-and-forth with paperwork ... Much less of a need for James' shortcuts too, I'd assume (they were too detailed for my taste and I would have just stuck with having my wife email her choice of agent to save a little while lol) ...

SOOOO - I could get a bill for one thing, pay it that day, and lo and behold, the second bill would be on it's way to my house from the NVC?? OR are they also sending their bills via email/online (which would make the process near instantaneous)...

I know we still have to get our share of physical documents to the NVC, but online payments DO sound a hell of a lot faster ...

Thanks for the input - if the I-129F goes through within a week I'll go with the K3, otherwise I may just drop it ...

I wouldn't wait for my I-129F to get approved because VSC is at standstill with those petitions and you can't be sure that they whether they are going to approve it or not.I would pursue CR/1 because it's a superior visa and NVC time is much shorter now.I noticed that we have similar timelines and that we also got touched on the same day.My file was touched yesterday also but no sign of an approval yet.I hope that there is no RFE coming!Good luck at NVC!

It seems we have the same case. Yesterday May 7, our 1-130 was touched!! Looking forward to our NOA2.

Hi HBUNCH -- I understand your confusion because I was thinking it over quite a bit - but then, once I learned about the online payment system for the NVC, I figured it would be as fast as the K3 process and my wife would have a greencard when she got here! (Considering I have no idea when my I-129F will be approved, it may potentially be a shorter process!) ...

The latest update is that my AOS fee status changed to PAID on the payment website today so I printed out the barcode cover letter. I also called NVC and they had it updated in their system that it's PAID!

I mailed off my AOS packet this evening via USPS Priority Mail!

Feel free to ask me any other questions, although I've learned most of what I know about CR-1's new "fast" process from lotofpatience's thread on the topic!

Also have a look at my timeline to see if that helps clarify things ...

Thank you very much for ur time & efforts of giving all these information with the above stated, it was highly appreciated. However my hubby will call Vermont or NVC tomorrow 14th of May to verify the pending status of our I-129F. Our Lawyer did advised us to wait for another week or two for the I-129F. In case there is no action/s, i guess we will be opted to do the same as yours. Still please keep me posted, as i I will continue to monitor the developments of your case This whole process is a nerve wracking and the waiting period is totally INSANE!!! (#######!!!)

Same thing happened to me. My I130 got approved, really happy!! :) But I checked my I-129f; the status remained the same: RFE received and case resumed processing. What does this mean, is it approved and just haven't changed the status on-line, or are they still processing it?

If they are still processing the K3, that's strange, cause if the I130 has been approved then surely the I129f should be approved as-well.

On our I130 form, question 21/22 (whichever it was) we stated that we intended to go done the K3 route. I hope it's been approved, as I don't want any further delays!
