Hello, I just had a quick question. My husband is about to go for his interview at the consulate in Vancouver on Feb. 13th. We asked an immigrations officer if he had to have the affidavit of support and he said he didn't have to, but it would be helpful. Does he HAVE to have this? Also, besides pictures, that's all he really has as evidence of us. Will he get denied if he doesn't have anymore proof or the affidavit of support?

Thanks!

kuharski,

You asked what kind of "immigrations officer"? If not a consular officer in the IV unit in Vancouver, you might want to ask again of someone who is a little bit closer to the situation.

It is true, however, that the I-134 affidavit of support is an optional document required only at the discretion of the cunsular officer. Does your husband have other good evidence that he will not become a public charge after entering the USA? If so, the consular officer may decide that an affidavit of support is not required in his case.

Thank you for your reply, my husband and I both asked an immigrations officer at the airport and a Director of some sort. He's above supervisors. Not sure exactly what his title is. Anyway, I'm going to fax my husband my Tax return, phone records and bank accounts, so that should be sufficient, right?

kuharski,

I can't tell you, any more than an airport CBP supervisor can, what the thinking is in the DoS IV unit in Vancouver. Neither one of us works there or knows the local policies.

Nor does either one of us know what your tax return, phone records, and bank accounts show about your financial situation.

The only person who can tell you if these things are sufficient is the consular officer handling your husband's visa application - after they have reviewed the materials.
