My spouse is premanent Resident. She Filed I-130 for me in April 2004. I am also in USA on H1-B visa and we lives together. I -130 got approved in 2007 and case was sent to NVC. We received case number in copule of days. After 6 to 8 month, that is in end of April 2008, We received Choice of an Agent and AOS fees bill. Sent it next day and we received IV bill of $ 400.00 yesterday (5-5-2008). We sent the fees today.

According to Visa Bulletin Priority dates for Indian Citizen in Category 2A is 08Jun03. What whould be the next step for me? I am already in USA on H1-B visa.

After you pay the $400 IV Bill, you will receive the DS-230 coversheet for you to send in all necessary documents to the NVC along with the DS-230. You will need to send them original or certified copies of the following:

Birth Certificate

Court and Prison Records

Deportation Documentation

Marriage Certificate

Marriage Termination Documentation

Military Records

Photocopy of Valid Passport Biographic Data Page

Police Certificate(s)

They have to be either in English or in the official language of your country.

Yes, good information.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

I have also paid Fees for AOS ($80.00). Do you think NVC would send anything to India?

Since i am in USA, is there any shortcut that i can consider to expedite the procedure? I have read some of the forums and they were referencing to received AOS package also. I havn't received anything like that.

What would be next and howmuch time it would take since the petitioner is permanent resident?

Yes, absolutely. The NVC will definitely be sending your completed case to India so your spouse can interview with the embassy.

I'm not sure if being a permanent resident matters at the NVC, I'm thinking that it doesn't since you already waited at the USCIS to have the I-130 approved. Maybe the NVC will have a better answer for you but again, I don't think it matters.

The shortcuts you can follow are in the first thread called Time Savers, please read pages 1, 10 & 11 to familiarize yourself with the process and the shorcuts. You might also be able to get a IIN from the NVC so you can pay your IV bill online and print out the DS-230 coversheet which could save you 2-4 weeks of waiting time.
