K-1 processing please help!!!

Firstly a big hello to everyone as this is my first time in posting and secondly my Fiancée and I are in desperate need of some advice regarding our K-1 visa application. We made the application at the end of December 2007 and received the NOA1 quite quickly, however they then asked for my Fiancée to sign the G-325A form and send back (Apparently she forgot to sign although she maintains she did)by the 1st of April to prevent delays, which she did well before. My Fiancée then had the G-325A forms sent back stating they needed payment for the visa application, puzzled she sent it back with a letter stating they had received the money because the cheque had been cashed (She supplied bank and receipt evidence). Anyway we have since had another update stating they received the RFE back on the 16th of April and processing has been resumed.

I have to admit I am a little bit annoyed with stating they have received the RFE and case processing has resumed for the 16th of April, when firstly the original request was sent back well before the 1st of April and secondly the 2nd time was their mistake because they failed to notice upon receiving the RFE back from us that they had already received payment. This delay may cost us big style and at the moment my Fiancée is quite worried and upset by it all.

My other query is that I have noticed from other people's timelines that they have been filing their K-1 applications towards the end of January 2008 and in some cases have received their NOA2 and have had their interview already! I would not mind if it were a different processing centre but its not its Vermont and yes while we did have an RFE, it was stated that if we got the info back to them before the 1st of April there would not be a delay. Therefore as far as my Fiancée are concerned, if there have been any delays caused it has been as a result of uscis making a mistake.

Oh and one other question, does it make a difference where my Fiancée is from? because although the processing office is Vermont she lives in Albuquerque.

Unfortunatly the whole process is transparent as to why some cases are dealt with quicker than others. There are some still waiting from last year with no rhyme or reason why they approve some quickly and not others. I was one of the lucky ones.

If you update your timeline it will give you an approximate date when the appoval should be recieved and it also helps others to help you with questions you may have.

If you update your timeline it will give you an approximate date when the appoval should be recieved and it also helps others to help you with questions you may have.

Thanks for the reply and congratulations on everything running smoothly! I will do the timeline like you suggested. Yes I know what you mean about the processing times for individual cases but it just seems a bit strange when you read on the uscis site that they process cases in order to be fair. As far as I can see it seems to be a far from a fair process with others in a far worse situation than myself.

Yep, it is unfair and we know they dont process in order and bear in mind also VJs are only 5% of the applications they recieve.
