Hi,

Do the affidavits need to be notarized? I read conflicting stories. One said yes and one said no.

June 06- NVC sends file to Naples

July 05- Call Naples to follow up, they say it can take 6 weeks before they receive it

July 15- Call Naples, this time they tell us they sent the Packet 3 snail mail on June 16th! one month of waiting wasted!

July 15- Receive Packet 3 via email (finally!)

July 15- Faxed Packet 3 back to Naples

July 26- Received interview date (8/31) via email

Aug 31- Received visa!!

Sep 09- My love finally arrived

Oct 14- Tied the knot!!!!

Nov 18- Express mailed AOS, I-131 and I-765

Nov 25- Received NOA for AOS, I-131 and I-765

oh i'm sorry! I got confused.

you do not need them notarized unless your interview is passed the expiration date of your NOA2.

you do not need them notarized unless your interview is passed the expiration date of your NOA2.

Heh, you're still confused. Affidavits in support of the I-751 should be notarized. However, federal law (28 U.S.C. § 1746, to be precise) does permit one to append the following declaration in lieu of notarization when one is required to submit a sworn affidavit:

I declare under penalty of perjury that the foregoing is true and correct. Executed on (date).

We did not have the letters notarized, nor did they have the sentence James posted above. (Just plain forgot the letters were to be notarized!) We were recently approved. I think given the other evidence we sent in, the letters not being notarized probably did not have much effect. But, I am just speculating and sharing our experience.

4/01/08 Case transferred - to an unspecified "USCIS office" (e-mail)

4/12/08 Letter - transferred to CSC on 3/27/2008. (typo in name)

4/22/08 Current Status: Card production ordered

4/25/08 Current Status: Approval notice sent; letter from Senator's office - expect 30-60 day wait for USCIS response!

Its better to have them notarized, but it is not a requirement. All of ours are notarized because I think it looks better and shows that the affidavits are true and are not just made up by joe bloggs! It saves USCIS time as they don't have to call the person to testify and lets face it...USCIS needs all the help they can get to approve our petitions faster! :lol:

I-130 for both parents

March 28th 2013 - Priority date/ NOA 1
November 14th 2013 - Transferred to Nebraska Service Center

January 7th 2014 - Case changed online to approved for both

January 8th 2014 - case changed to shipped to NVC

January 9th 2014 - case changed to NOA 2 mailed

January 10th 2014 - Received the hardcopy of the NOA 2 stating that NVC would issue a case number in 30 days approx.

January 21st 2014 - Case Received at NVC

February 26th 2014 - Case numbers and IIN number received - Wrong embassy code assigned...now waiting for new case numbers.

March 3rd 2014 - Filled in DS-261 for both parents

March 5th 2014- AOS available, paid and submitted AOS packet.

March 6th 2014 - USPS shows packet was delivered at NVC

March 10th 2014 - AOS shows as paid in the CEAC portal/AOS logged into system as being received by NVC.

March 11th 2014 - New case number assigned for my Dad.

March 20th 2014 - Paid IV fee for my Mum.

March 25th 2014 - AOS accepted by NVC with no checklist.

March 26th 2014 - Filled in and submitted DS-260 for my Mum

March 31st 2014 - AOS found in my Mum's file for my Dad - accepted and placed into his file/IV fee available for my Dad and Paid.

April 1st - Mailed all civil documents to NVC for both parents.

April 3rd: IV fee shows as paid in portal/submitted DS-260 for my Dad.

April 22nd: checklist issued for civil documents - NVC error ...

April 23rd: sent another certified copy of my marriage certificate

April 24th: Case complete! :)

April 30th 2014 - Medical scheduled for parents at Knightsbridge in London

June 11th: Interview at London Embassy - Approved :)

Actually, the instructions require that the affidavits be "sworn." That means they should be notarized or, if not possible, have the declaration quoted above.

We have not submitted affidevits because our lawer told us that there is no need. I followed his directions because if you do immigration law for 20 years, you have to know something in the craft. Seams that financial comminglig is way more important. If you have other proof-I would not bother.

We didn't submit affidavits either. We submitted financial records (insurance, tax, loans) and birth certificate of our daughter. I don't think you can beat birth certificate though. But then again, the application is still pending, so knock on wood.
