no green card AOS filing????

Hi

I have a problem. I read that you *must* have your green card to adjust your status. The problem is that I never received my green card and was due to replace it. The original card was lost in the mail and the USCIS decided that I had to pay to replace the card. I didn`t have $260 spare and have not had that kind of money to spare so I have never been able to get my actual green card. So I was hoping to eventually get that replaced but of course I NEED to adjust my status. I did manage to get a stamp in my passport which effectively extended my temp I551 but will that suffice for AOS?

I don`t know if anybody can help me or if anybody knows but I would appreciate any and all help on this topic. thanks a lot in advance.

If you entered on a CR1/IR1 visa, then you don't need to file for AOS. What was the date of your entry into the US? If you entered after your 2nd wedding anniversary, then you should be recorded as an IR1 at the POE and get a 10yr green card. If your date of entry was before your 2nd wedding anniversary, then you will be recorded as a CR1 and get a 2yr (conditional) green card. With a 2yr green card you will need to file the I-751 (Removal of Conditions) 1yr and 9 months after your date of entry.

As a green card holder, you are required by law to carry your green card. So, you might need to get that I-90 filed so you will have a physical card as the I-551 stamp is usually only good for 1 yr.
