My wife will come to the USA soon on a K-3 visa. I understand that she needs to file for for a change of status for permanent resident once she gets here, but does she have the right to work before then and how soon can she have her green card? Thank you for your help and information :thumbs:

I-130 PROCESS

12/21/2006 - Married

3/16/2007 - Sent I-130 USPS Priority Mail

3/19/2007 - CSC Received I-130

3/22/2007 - NOA1

3/23/2007 - Check Processed

8/22/2007 - RFE

9/14/2007 - Sent evidence to CSC

9/23/2007 - CSC Received Evidence

11/1/2007 - NOA2 - Approved

1/7/2008 - NVC Received package

1/16/2008 - NVC sent pkg to France

1/23/2008 - France received package

1/29/2008 - Spouse received instructions

3/11/2008 - Completed/sent DS-230 to USA Embassy

4/1/2008 - Received appointment date

4/14/2008 - Spouse received medical exam

4/24/2008 - Interview date

4/24/2008 - Visa Approved

4/30/2008 - Visa arrived

She can apply for an EAD right away. But it will take about 90 days to get.

If she applies before she applies for AOS, the EAD will carry a seperate fee, otherwise its included in the AOS fee.

K3s after to get green card and SSN or get EAD and SSN before they can work.

Best to apply for EAD and AOS at the same time as the EAD doesn't cost then.

apply for both together soon as you can.

CR-1 would have been a LOT quicker and cheaper!!!

K3s at this time SUCK!!!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Thank you for this helpful information. I plan to file the I-485 as soon as my wife arrives, and imagine that the time varies from case-to-case.

Your timeline shows I-130 approval! Why don't you go with the CR-1. She will have her Green card and SSN in the mail within a month of arrival.

No need to pay the $1010 or go thru the paperwork and stress of adjusting status.

That might be a little difficult, as she has had her medical, interview, and already has her K-3 visa in-hand. I wish I had known this earlier :unsure:
