Ok folks time does some strange things on a person mind !!!! So I was thinking since we were denied our K1 visa becasue the consulate offficer thought we were already (WHICH WE ARE NOT) He said for us to file for a I 130. What is that ? Also I was reading about a K3 visa !!!! Can some one help me out with that too !!!! Here is my big of an idea !!! What If we did get married here in Juarez and filed for one of thoes two visa types !!!! Remember I am new to all this and running at this blind. But that is what they say about love sometimes to it is blind so i think we are good !!!! LOL !!!! Does Juarez have DCF filling ??? What time frames would I be looking at then !!! Also if you have read my other posts you will see my postion here !!! Let me bring you to speed here if you havent, Please remember we do have our congressman and our attorney making an appeal for us !!! I have also since the last post contacted our Senator !!! Time is Money here !!! As we all know I have more time than money !!!! I just want my baby home with me !!! Thanks for all thoes who have supported and helped us so far !!!! I wish i would have found this site long before now !!!! Thanks Chuck and Teresa

Hi Chuck, good to see you're still trying to sort this out and looking at all your options in case they wont hear your appeal! Is your case still in Juarez? Did you visit the immigrate to us forums? Those folks really seem to know Juarez inside and out and they would be the ones i'd talk to about your options. ;)

Most countries now have a 6 month 'legal' residency requirement to file for DCF. If it's an option for you, that may be your best bet if the K1 appeal is denied. If not, you will need to legally marry and file for a spousal visa.

Hopefully someone will be able to convince them that a license to marry does not mean you are married and they will approve your K1. ;)

Have you done what Kim has suggested? I think that would be a good starting point.

If you do not think that is an option then read the guides on here for the K3, CR1 and DCF. The guides will have the answers to what you asked.

p.s. I understand you're just looking at the 'what-if's' but don't you dare give up on that K1 without a fight! Yes, bringing the license was probably not smart ( :bonk: your so-called lawyer!) ...but it does not mean you should be denied. The only way things even have a chance of changing is when we fight for what's right!

Thanks for your advice !!! As of now our file is still in Juarez and our attorney has made an appeal for us !!! Who know how long that will take. Also our Congressman Cleaver has written a formal request for review. We Provided our congressman with all our documents and the consulates decision ! They are both full aware of our issue here !!!! I have also contacted my Senators. The thing that bothers me the most is that we had the burden of proof and the documents they asked for !!! But the denied us any way !!! I would think they would have to provide us with eveidence of their decision !!! To me it is like they are saying you are comitting fraud and go away or you will be punished... So we will continue to Wait and PRAY !!!! Also How is that for Homeland Security that US goverment will not look at its own websites before they make a desicion to allow anyone to go or stay in the US. Isnt that what this is about any way.Because of one mans opinion is above the law in this case. How safe should we feel when this happens. Just thinking out loud but our case was approved with the same documents long before we got to this point. So my thoughts are many hear us before it happens again to anyone !!! We pray this issue can be resolved quicky and also want to stand up for our rights as well as the rights for others.... Together we are strong !!! Chuck and Teresa

Thanks for the reply !!!! Breathing in !!!! Breathing out we are making the appeals and that we believe are avaiable to us !!! We have contacted our Congressman and our attorney as well as our Sentors !!! This is a complete injustice and should have never happened we got our apporal with the same documents we took to the consulate for our interview. There should have been no surprises reguarding our paper work... If it would have been an issue we should have been denied from the start... We are free and clear to be married and to much time has pasted already that I have been away from my future bride. This is negligent and irresposible on the consulate office.... It out rages that even though we were approved with same documents and went to the interview they made us get another certified document from my state saying we was not married which we had to have Fed Ex to Juarez and wait more days !!! They still denied us even with further proof !!! They refused even after we provoided them websites of there own goverment !!! They made us wait 7, 8 months to tell us it is not their job to look at these sites and our eveidence !!!! It was only their job to approve or deny any visa... They continue to say we are married and we have to file for I 130.... SO now they think we are going to take this lying down but WE ARE NOT !!! By the way I am still breathing !!!! I think they have gotten away with this in the past before and they may think it is even funny or cute for people to have to jump through all these hoops and be away from there loved ones !!! Well not this guy I am going to exhuast my resources and expolit them until they review our documents and see that we are not married and give us a fair reveiw !!! This is devasting to anyone !!!!
