OK ... We're married ... now what?

Hello,

My new wife (!) has been here for 45 days with her K-1 visa. We're going to send in the paperwork for adjustment of status by the end of May ... sooo what happens to her as of JUNE 22, 2006, when her K-1 visa expires. I mean, we will have been married within the 90 days but there is no documentation allowing her to stay.

What should we do?

She will be an "adjustment applicant" -- which is a legal status.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

1/27/06 - Check cleared

7/10/06 - NOA2

7/14/06- rec'd @ NVC

8/14/06- NVC sent petition to Consulate

8/17/06 - Korean Consulate rec'd Petition

8/23/06 - rec'd packet 3 from Consulate

8/25/06 - sent packet 3 back to Consulate

8/27/06 - got confirmation email from Consulate, they rec'd packet three

8/27/06 - requested interview date via Consulate internet site.

9/1/06 - Checked internet site for interveiw date, it was there

9/25/06 - Interview date - APPROVED

9/28/06 - Visa in Zaeems Hand - YEAHHHHH

1/6/07 - leaving for USA

1/20/07 - Wedding Date

1/20/07 - MARRIED!!!!!

2/10/07 - rec'd certified copy of marriage license

AOS

3/13/07 - AOS package rec'd at Chicago Lockbox

3/20/07 - Rec'd Social Security Card

3/21/07 - Checks Cashed and Case Status online

3/24/07 - NOA1 Rec'd for AOS and EAD

3/27/07 - rec'd Biometrics appt letter - scheduled for 4/20/07 @ 11:00am

4/02/07 - "touched"

4/20/07 - had biometrics appt.

4/21/07 - rec'd letter stating case was transferred to CSC

5/22/07 - rec'd Case Pending at CSC email

6/25/07 - EAD card production ordered

7/7/07 - EAD "touched"

7/7/07 - AOS "touched"

8-6-07 - Rec'd EAD Card in the Mail

5-20-08 - AOS INTERVIEW - APPROVED - PASSPORT STAMPED

7-2-10 - Received 10 year green card in mail

SSN arrived more than a month after.. GRRR!!

November 21, 2006- Received official marriage certificate

Dec. 19, 2006- sent out AOS

Jan. 3, 2007- Cashed cheques for AOS and EAD

March 15, 2007- AOS interview; APPROVED!!

March 23, 2007- Welcome letter/notice received from mail

March 27, 2007- GREENCARD

Sept 5, 2007 - my first anniversary in the U.S

Jan 30, 2009 - Mailed I-751 removal of conditional residence status

Feb 2, 2009 - Package mailed 10:22 AM at Laguna Niguel, CA (CSC)

Feb 5, 2009 - Check cashed

Feb 26, 2009 Biometrics

she will be kinda in the same situation as my husband. his k-3 expired on may 2 and we are still waiting on the green card to be approved.

its like he is legal and illigal at the same time. he is legal to live here because he is in process of aos but if he leaves the united states without advance parole then he is illegally trying to come back in when he comes back. strange right?

well good luck with ur new marriege and new life together.

just remember if she wants to travel she needs that advance parole which takes around 3 months to get.

Congratulations. Once you file the AOS your wife's status will change to 'Adjustment Applicant'. It is a legal status, although the only proof you will have is the NOA1 which will acknowledge your submitted application. It would be a really good idea to apply for an employment authorization card (EAD) at the same time because that card should arrive within 90 days (or less) of submission, and is proof she can carry that she is legally in the US. As was mentioned above, if she leaves the US for any reason without an Advance Parole (AP), she will be considered to have abandoned the application, so be sure that doesn't happen. Good luck:-).
