Name change(second time) after applying for AOS

My spouse already received the SSN with the name changed and we applied for AOS based on the name change.

Now, my spouse is considering using my first name as her last name...Wouldn't it be better to change the last name again once we receive the Green Card?

Would we have issues changing SSN again? Do we need a court order?

Has anyone gone thro' this experience ? If so, please post them...

To change a name on green-card after AOS is approved involves returning the card along with form I-90 and paying a $370 fee.

Yep..using my first name as her last name...Its culturally followed/accepted in several countries..

That brings up additional Q...Can we change the name while *removal of conditions* ? that would save some moolah...

Yes, many do it at that point because they had filed AOS using maiden name.

I would say she will probably need a court order to make that change on the SSN record, unless she does it through the naturalization process. To make the change on the SSN record based on marriage state law has to allow it and I don't think any state allows a first name to be used as a last name through marriage.

That's interesting...I haven't researched on state laws yet...but why does the state care who's name you want to take?

I thought you can change your name to *any name* if needed....

A. NEW POLICY NAME CHANGE DUE TO DOMESTIC MARRIAGE

2. Evidence of New Name

Accept a document listed in A.1. as evidence of the new name if the new name can be derived from the document. RM 00203.210B.1 shows examples of how to derive a new name from the marriage document. This EM makes the existing Interim Guidance in RM 0203.210B.1.a. to RM 0203.210B.1.c. permanent and is applicable to these name change requests:

-- bride takes the groom's last name;

-- groom takes bride's last name;

-- spouse takes the other spouse's last name (e.g., same-sex couples); or

-- compound name (with or without hyphen) of each spouse's original name for either or both parties.

If the new name cannot be derived (e.g., entirely new surname not shown on document), other evidence of legal name change must be submitted (RM 0203.210B.1.d.)
