Hello Everybody.

I Received an e-mail today that my I-130 and I-129F forms were approved and a approval notice has been sent. Im doing a

K-3 visa but now that my I-130 has been approved together with the I-129 do I still go forward with the K-3? Im a little

confused. If anybody can answer me I would appreciate it. Thanks

According to USCIS document they are supposed to hold the I-130 in favor of the I-129F and proceed on with just the K-3. Read: http://www.uscis.gov/files/pressrelease/PN_i-129f.pdf

However many reporting VSC holding I-129F and sending I-130 on to NVC.

Is now a US Citizen immigration completed Jan 12, 2012.

a K-3 visa when I-130 is approved. am i right? or am I missing something? thanks

No way to cancel the I-129F once it is linked to the I-130, some have tried only to have USCIS kill both petitions.

If they do hold the I-130 back, the only thing you can do to keep it moving to NVC is file I-824.

USCIS has been doing this because the vast majority of K-3's were adjusting status rather than do counselor process of I-130, this was wasting a lot of Department of State's time.

The decision to do K-3 OR CR-1 needs to be made by the petitioner BEFORE filing the I-129F

I would have responded similarly six weeks ago but we're starting to see a number of petitioners get both petitions forwarded to NVC lately.

In any event, there's no need to do anything about your K3 process at this point. It will proceed without input from you until it arrives at the Consulate abroad. I would now wait and see if both petitions get to NVC. In the meantime, check the specific timelines for your country from NOA2 to interview for CR1 and see if you think you'd like to pursue that.

Thanks on both of the replys. Im gonna go ahead and wait on NVC to see which petition is gonna be forwarded. I probobly should stick

with K-3 so i don't complicate things even more. Thank You Again

Also, if you already did the medical and all, do you need to do it again at the consulate?

Leaving $$ issues aside, does it make sense to go I-824, or it is just faster to AOS from the States directly? My no. 1 priority is the EAD (for which I understand there is a 3month wait usually after filing AOS), not the actual green card...

I-824 takes a minimum of two months then two to four months through NVC, so the I-130 will be 4 to 6 months behind the I-129F. If you file AOS and EAD right away, chances are you'll be together 3 or 4 months sooner and work authorized 2 or 3 months sooner.

On the other hand, we've seen the the I-824s take a lot longer than two months.
