CR-1 Visa birth certificate translation

I did a quick read of the I-130 instructions. It says nothing about name change. Only divorce papers.

You shouldn't need your birth certificate.

Sorry no templates. My friends wrote personal letters with details about when and how they met my wife.

I don't think you need the affidavits , since you have phone and bank records. I was only married for two days when I filed :). So we didn't have anything shared yet.

two affidavits from friends.....like letters or essays??My husband is going to ask his boss and friends to write some letter as affidavits..do they have any forms for it??

I take it back ... it says this in the I-130 instructions:

"If either you or the person you are filing for is using a nameother than shown on the relevant documents, you must file your petition with copies of the legal documents that effected the change, such as a marriage certificate, adoption decree or court order."

Still, I don't think your need a birth certificate... Its not on the list above.

I'll re-read the I-130 instructions but a name change doesn't require supporting documents.

Please point me to where that is stated....

I might add that my wife changed names twice (due to previous marriage and our marriage). They do ask for divorce documents, so I guess that supports the first family name change. I didn't send anything for the name change to my family name.

On the I-130 instruction it says"If either you or the person you are filing for is using a name other than shown on the relevant documents, you must file your petition with copies of the legal documents that effected the change, such as a marriage certificate, adoption decree or court order......"

Sorry about this mis-information. I skimmed the first time. Then I went back and used the search feature... should have done that the first time.

In any case, I don't see how birth certificate will show an official name change. Also pay close attention to "shown on the relevant documents". Is the name on the documents your submitting different then it is now? Your marriage certificate would be all that is require for a change to your husbands family name.

On the I-130 instruction it says"If either you or the person you are filing for is using a name other than shown on the relevant documents, you must file your petition with copies of the legal documents that effected the change, such as a marriage certificate, adoption decree or court order......"

I filed in the US. I don't think you can file in Japan any more (unless the US citizen lives in japan).

did you file the paperworks in JApan or in US???

well the situation is ..I devorced before and the birth certificate is to proove my marriage is over...

My name has changed 4 times ...not from the previous marriage but from my mothers devorces....and some of the record arent on the family certificate any more...

Again, my interpretation of the I-130 instruction is they don't want evidence of EVERY name change just the ones that are not the same as on the submitted documents.

The only "Documents" you are submitting are your divorce papers and your marriage certificate.

If your *CURRENT* name is not the same as either of those, then you need to submit official documentation of the change.

Again, my interpretation of the I-130 instruction is they don't wont evidence of EVERY name change just the ones that are not the same as on the submitted documents.

Technically speaking, the G-325A is not a "document" :)... It's a form or an application. The way they phrase stuff can be confusing.

A "document" documents something :). Your application I-130 and G-325A are forms *filled* out by you.

I mean I wrote 4 names on the question therefore I thought i need some documents shows that my name has changed....it is realy complicated...

Regardless of my interpretation of the word "document", which is rather sketchy. The important phrasing is this part of the instructions: "is using a nameother than shown on the relevant documents,"

Notice the words "is using". "is" is present tense. So all they want is proof of your current name.

It is 2 am here in Japan (are you here?)... so I may be getting a bit loopy.

I'm waiting for my wife to goto sleep and have nothing better to do, so let me try and make my point a little stronger.

Think about it from their stand point, you've submitted TWO official documents from government organizations. The marriage certificate and the divorce certificate. In theory your name should have been verified by the issuing agency. Why would they need to verify it again? Answer: They wouldn't, unless you are claiming your name is NOT what is listed on those document. SO, they want ANOTHER "official" document showing the name you are using now...

Make sense?
