I am so confussed, my husband filled on March 27 (i-130) we got our NOA1 on April 1st but i really have no idea why everyone is applying for a I-129 after applying for I-130... please somebody explain me..... we went to the USA Embassy in Nicaragua together and applied for a non inmigrant visa (tourist) on April 22nd and it only took 2 seconds before the girl said that I wasn't elegible for a non-inmigant visa... what should I do now????

after u apply for I-130 its your choice if u wanna apply for I-129F, this is a fiance visa, but if u are married w/ the US citizen u can apply this also .

its non immigrant visa that let u come w/ your husband in the US while u are waiting for the immigrant petition filed. they said its faster than the I-130.

but it depends on the situation

When you are married and you have filed the I-130, you have a decision to make. You can file the I129F for the K3 visa. This is a non immigrant visa. You generally recieve this faster than the CR1, but when you are in the US, you have to do the process for AOS. But you are together sooner.

As far as which Visa to apply for, K3 or CR1. Ensure that you are making an informed decision, and looking at what is most important to you. People keep saying that they take around the same amount of time, but that is not true. Per the timelines, The average time to interview for the K3 is 242 days, while the average time to interview for the CR1 is 361 days. They are both approved around the same time, but the NVC sends the K3 directly to the consulate, where as the CR1 is held at the NVC for further processing. So with the K3, you will be together approx. 120 days earlier.

So you have to look at what is most important to you!!!!!! The CR1 is only a better visa if it is important to you that your spouse arrives in the US with everything complete. But in my case, the K3 is a MUCH MUCH better visa because me and my wife will be together sooner. This is all I care about!!!!!!! So for me, the CR1 is not a better visa.

This is the most difficult thing I have ever done in my life, being in the United States without my wife going to sleep next to me every night, not being able to hold her hand, not being able to give her a kiss, not being able to look into her eyes. So if the K3 will get my wife to the United States 1 day sooner, That is the much much better visa for me.

Yes, now, I wish that we would have done the K1 visa, because we would be together by now, but what is done is done. So make sure that you are making an informed decission as to what is most important to you and not what is most important to other people. Yes, with the K3, we will have to do AOS in the United States, but we will be doing it together.

Hi, the nightmare for me and my SO continues at the CSC. I'm a K3 filers from Oct 24 and still pending.I con'td my congress people and still waiting for bkgrnd chk, still same response when I call, ..wait another 30 days and call back. I wish that made the govt reveal truly how many immigrants have really done some some disloyal or criminal act, I don't think there would be many, most just want to began a better life with their family and love ones. How sad our own govt must view us all under the cloud of suspision and fear. My hope lies in my Lord who made the heaven and earth. I wiash everyone a speedy approv'l.

I think you mean I-129F, which is required for a K3 visa. The I-130 alone begins the CR1 visa path which is an immigrant visa. You enter the USA with work authorization and permanent resident status. It also cost a few hundred dollars less than a K3 visa process from filing to Green Card. Generally, the K3 gets you to the USA faster but sometimes not much faster. You arrive with two years of legal status but are not a permanent resident and are not authorized to work.

If you want to learn the process during the process, I suggest you study the "Guides" here and read about the experiences of others and the questions they have along with the answer given.

You didn't qualify for a non-immigrant visa because you intend to immigrate. As such, you need either an immigrant visa or K3. K3 visas have a path to immigration for the spouse of a US Citizen even though they are technically non-immigrant visas.

I suggest you and your husband carefully examine your priorities and check the difference between CR1 and K3 timelines (filing to visa interview, not just filing to petition approval) for Guatemala specifically and make an informed decision on whether to file an I-129F for spouse.
