Only one visit before asking for Visa K1

Hi guys:

I would like to know your opinions about these: I met my fiance one year ago by internet. He came to Lima for meeting me on january 2008 and stayed here per a month. Then, he started with the Visa K1 process. So we received our NOA 1 on march 24 and we re waiting for the NOA 2. My question is: you think that we could have problems with the k1 Visa if my fiancee only has came to Peru one time and not more than that? You think that would be a problem for getting the visa K1? Or USCIS could deny us the visa cause they think that we dont have a real relationship?

I just started thinking about it and Im a bit worried, please tell me what you think about it...

to ease out your worries, my husband who was then my fiance' had visited me only once and started filing k1 soon as he went back in US. We've encountered no single problem at all with our papers and I went to my interview all by myself too and was approved right away and got my visa 7 days after. Important thing is you met in person before filing...

With your application to USCIS all you have to do is prove that you've met, in person, at least once. They don't care how many times, as long as there is ONE. Once you get to the interview stage you'll have to prove an on-going relationship. As long as you have letters, phone records, chat logs, pictures of you guys together from his trip, etc you should be fine. My fiance and I always talk on the computer but we make sure to call each other a couple of times a week and we've mailed birthday cards and stuff. We would probably have done this anyway, but we make an extra effort to make sure stuff is physically mailed because there there is the post stamp and both of your names and addresses. It's good proof of your relationship when you get to that stage. :)

Yep, having met in person once is enough ... but as stated, you'll need to provide on-going relationship proof at the interview stage!!

Much better if he visits you more than time as they most always ask how many times have you've met.

At the same time MANY peeps get their visas having only met one time.

Staying for a month is a plus for you. Some did much shorter.

Obviously it's better with multiple visit to get to know each other better.

My first K1 was denied as we only met once for a short time and didn't have enough evidence of having a bonafide ongoing relationship!

And to add on the above, there's even a few lines where it says that people don't physically have to meet each other before filing but this is only some really rare cases lol.. dk how ppl like that will be processed tho lol

I also agree with all here. according the law it is not mandatory but i think it is very, very, very important have met in person. they asked me the same 3 times at the embassy. do what people here says, take mails with stamps on the envelopes, phone bills, highlight the calls you want to prove, chat logs, get a scan of his passport with the entry/exit to Peru, get a letter from him, original, with his will to get married and support you so you wont become... how do you say... carga publica, there are examples somewhere here....

On April 29, my fiancee (in Ecuador) received a "failure to issue the K-1" and orders to for me to personally appear with her for a "marriage interview" later, with more "proof of the validity of the relationship." Although there were other factors (the consul was wearied by a truly bizarre interview just before my fiancee saw him), the concern was that I had spent only 5 or 6 days visiting on each of my THREE visits. The consul wouldn't even look at the copious evidence that my fiancee had brought. The lesson here is that they can and will focus on ANY reason to deny or refuse to immediately issue a K-1.

So, I must visit for a joint interview on June 30 AND provide "proof." I have compiled a log of all saved e-mails that we had sent since Day One (not just printouts of a few selected ones); I've copied my phone records; we will provide ALL photos that we took, not just representative ones; and we are collecting testimonial letters from our families, friends, colleagues, neighbors, and anyone else who has met us or can attest to the validity of the relationship.

This must happen despite the very clear statement on the Consulate's website that "only the applicant will be allowed in the interview." The trip will cost me over $1,000 and days off work, yet of course it is necessary.

Take it from one who is now sadder but wiser: Especially for Latin American K-1 interviews, I very STRONGLY urge that the U.S. fiance(e) be there at the Consulate or Embassy for the FIRST interview, in case the consul wants to call him/her in. Do not risk questions about the validity of the relationship by letting your fiance(e) attend alone, especially if there is any possible opening for the consul to question it!

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Thanks to everybody for your answers. That helps me a lot, Im sure that just in case they require more information, we will be able to proof them that we have a real and ongoing relationship: we talk everyday by phone, we send emails, we have lot of pictures together, also with my family and on my birthday, etc etc. So I think I dont have reasons for being worried :)

TBoneTX, Im sorry for the situation that your fiancee lived on ecuatorian embassy (so silly people!!!!). I hope that in June you have better moments on the embassy and get finally the K1 visa for her. Yes, you re right, even if I have readen on visa journey that its not necessary my fiancee comes to Lima for the interview, I would like to have him by my side giving me his support and presence. So for that reason he has promised me that he will come and being with me. We want to avoid any risk or possibility that consul could deny the visa for silly reasons.

Gracias, Angela. I cannot emphasize it enough: Bring ALL of your evidence. If he has ever sent you money via Western Union, bring those records. Have him bring his pasaporte with the dates of his Lima visit stamped inside to show them (or, copies of all pages of the pasaporte). Everything else that you can think of, bring it!

The guy who interviewed before my fiancee (who heard everything) was a real piece of work. He begged and pleaded to come to the U.S. "for a better life, and to be with my loving wife, whom I have loved for 20 years." No matter that his two teenaged sons (with him right there) were not that woman's children, nor were HER two children fathered by HIM. My fiancee said that it sounded like a confessional with a priest, or like a very bad telenovela. The Consul managed to take a full hour of this. Afterwards, instead of taking a 15-minute break to recover from that garbage, he called my fiancee right away. She never had a chance. This is a real-life example that [1] the consuls are human, and [2] you never know what situation you'll find yourself in.
