seems to me that we "people who lost 45 days or so to NOA-1" will get the shaft

Here is my story. I've lived problem free life, payed my taxes. One day I decided to marry this girl. But to do so would require her to come to US of A, and so it started. My problem free live turned in to free problems from USCIS! Sure things turned to unsure, certain dates turned to aproximation within months. All logical thinking was out the door, as I filed my papers withing famous Vermont Centre!

I contacted my Senator regarding my case last week. I was just informed by the Senator's office that they had made the inquiry with USCIS and since my NOA-1 is dated February, I will have to wait until August 2008 (6 months from NOA-1) before I can inquire again. That's 10 months since I originally filed. 107 days passed between filing and NOA-1 issuance and I have no options right now. Completely frustrating.

02/02/2009: Responded to RFE with brand new AOS based on 2008 tax return (if that doesn't shut them up, dunno what will)

Ilya, from someone who was turned down for an expedite for a death and also terminal cancer, I'd involve everyone if I was you. It would be wonderful to see someone get out of all this sooner.

My denial was quite a kick and I don't have the energy to chase it all the way to the White House, but I am totally supportive of anyone who attempts to get ahead .... I certainly do not think you're doing anything wrong when H1-B filers get to bring their families over in weeks.

Hopefully you'll find someone to give these mules a kick!!

And Pushbk, your help is great, your snide comments however are really uncalled for.

If you're attempting British sarcasm, you need to practise a little more. Till then, keep up the good work with the knowledge as you're really quite brilliant :thumbs:

Is there any way we can expedite process...if (spouse)beneficiary is depressed which is a valid medical reason?I am just curious? anyone have any idea?

I love all this chatter about corruption and whatnot .... the fact is ..... because none of us are millionaires or have high government connections we have to wait.

If we had the cash to simply buy our visas .... let's say a small donation of about $1million we'd have our visas within 24 hours .... you know that .... I know that .... and this waiting while H1-B visas are wizzed through is a load of old rubbish! .... especially as the dollar is so damned weak it can hardly stand up, and the US is about to enter recession .... again.

All governments are run on corruption, and there's plenty going on that they will never tell us as we are just the worker bee masses.

Basically, in a nut shell .... the fact that there are born and bred USC's having to wait to be able to have their spouses live with them is truly rediculous. A black hole between NOA1 and NOA2, what crock of old BS is that??

Prisoners know when they will be getting out of prison .... they have a timeline

Soldiers know when they are coming back from war to see their loved ones ..... they have a timeline

But those who DARE to marry a foreign spouse are punished like naughty children and told to wait with NO timeline.

My military Husband says this process is actually worse than deployment .... and thankfully we've learnt the tools to deal with time apart, but it isn't right and you all know it.

We were denied an expedite which was based on a death as well as terminal cancer .... how dare the USC who is dying to want to see me again before she gets put into the ground before I'm 'allowed' to step foot on US soil again.

So what if Ilya wants to utilise his Congressman and Senator, bloody good for him I say!!

Some people are being approved who had the delay in receipting so there's a chance that there won't be a complete shaft. I think what they're telling us though is that until 180 days from the NOA1, nobody will lift a finger to help despite the fact that we were told they'd honor the actual receipt date and not the NOA1 date.

We really don't have a choice but to resign ourselves to the fact that we have zero control and zero influence.

If I had to do it all again, I would have not gotten married, he would have come under NAFTA, we would have dated a while longer (or maybe a lot longer, who knows?) and we would have gotten married later and just adjusted status. But no. I wanted to do things the most honest way. And all that has done is cost us a lot of time and money and it has damaged my trust in my government.

I recently contacted my rep: Senator Barack Obama's office and got a call from them today. They called USCIS, but unfortunately can't do anything until June 10. Since I got an RFE because of those pictures, USCIS has 60 days to let me know something. If I don't hear anything by then, I was politely informed by the intern at Obama's office, they will be glad to file an inquiry for me.

I'm an August filer. So, I'm feeling the pain, too. But we've gotta hang in there. Staying busy really seems to be good therapy. I hope all our cases speed along. Good luck.

If infact USCIS is using the NOA1 date, mine is in january.. so december and january filers should still be waiting, right? It took over 90 days to get my NOA1 :bonk:

Kitty, sadly for all you guys who filed in October and got caught up in the delays had your NOA1's delayed considerably.

Technically you should be correct with December/January filers should still be waiting, but instead they clumped a lot of us together with late 2007 filers and gave us all very close NOA1's.

Is that fair for you guys ? ... no.

December NOA1's appear to be almost at the end and they have definately started on January NOA1's as they are a good quarter of the way throught them. But in those January NOA1's, you also have some December filers.

Kitty, I pray your approval won't be much longer as this system is not really a system at all, it's just an abuse of power and human rights.

UPDATE: for anyone who cares.(please people who dont have anything positive to say about this topic just dont post)

After another few conversations with congressman's Office, they took my complain(s) and forwarded me to Zoe Lofgraen Office. There I spoke with a knowledgeable guy, we discussed all the problems that is going on. He said they are aware of the problems, and they have tried to change the system so there would be an easier immigration process, but the republicans always vote against it. He said in the long runs, most of republicans don't care if you wait 5 years or 20 years. He also said that there is only one side of the story with immigration. That there is too much illegal immigration and that there is no one to speak on behalf of immigration party. So it gets ignored, thats why its so simple to get here via work visa without any backlog. Thats why there are Priorities and I-130 isn't one of them. People have yet to speak out. Sub Committee cant do anything directly, but there is lot of information out there. 13-15 months of backlogs will never get cleared no matter how many workers they have to "hire" and "train". A normal approval process of I-130 should take about 90 at most, but due to faulty system and absolutely no chance of fixing it it'll only get worse. The guy was right about one thing, ask any kind of blue color American about immigration, what will he say? He'll prolly point out the illegal immigrants first, and thats all there is. Nobody knows about us, and nobody cares until we let them know. He suggested going through press. I might just do that. Pm me with any suggestion as I will contact NY Times on Monday.

August 8th 2008: Called NVC and spoke with operator. She stated Sept 29th at 9am is when the interview is scheduled for.

Sept 29th 2008: Wife had interview. Medical exam was about to expire before our flight so we had to get another one. Mailed it in to the embassy and got wife's visa a few days later in the mail.

Oct. 20th 2008: Wife, daughter and myself arrive back in America. POE took a whole 10 or 15 minutes.

Oct. 21st - forever: Happy to be with my wife and baby girl.
