hi!

I have a K1 Visa.

Last week, I entered the USA through Philadelphia Airport. I asked for a work authorization but they told me to send the I-765 form.

I married my fiancée and sent my AOS/EAD/AP applications.

I am frustated not to be allowed to work, while those entering through JFK can. Do you think JFK immigration service would stamp my I-94 if I go there now (by train)?

Are there any other solutions for me to be allowed to work until I get the EAD?

I went to my local office in Philadelphia, they told me the only way was to wait for the EAD. They also told me that JFK doesn't deliver temporary work permit, which is a lie since there are a lot of members of this forum who got their I-94 stamped in JFK.

I have a company ready to hire me right now, I don't want miss this opportunity.

Pointless, The POE is only accessible by way of international flight.

NOTE: K-1 is not a work visa, it is a fiancee visa for entry to the USA and marriage, K-1 is "Work Auth" primarily to be able to get the SSN, some states are strict in their interpretation of a federal law that requires persons applying for a "license" to have SSN, this can cause a problem with marriage license if only one person has SSN and the other (the K-1 holder) does not.

Only visa that guarantees work authorization upon entry to the USA us CR-1 and IR-1 Spousal visas, they get I-551 Green-card stamp at all POE.

Another note: EAD stamp from POE is only valid for 90 days after entry to the USA.

Even if you could, particularly if you are the least bit fussy about the type of work you want to do, you might find it very difficult to find that employer who will even employ you for such a short period of time...

What else can I do to obtain a work authorization? except waiting?
For K-1, the process is enter country, marry, and then apply for AOS+EAD+AP at same time, EAD can take 90 days or so to get.

If you apply for EAD before filing AOS you will end up paying $340, and get an EAD card that expires 90 days after entry to the USA. For K-1 it is best to file AOS and EAD together, EAD costs nothing this way, and is valid for 1 year.

Again: K-1 is not a work visa, it is a fiancee visa.

Eventhough unauthorized work is forgiven at interview as a result of a marriage to a USC, nobody here will tell you to just simply go to work for an employer who is already willing to hire you.

That's what I did, I just find ridiculous some people get allowed to work because they entered through JFK! I should have visited this website before booking my airline ticket!

I know, I am immigrating in the US to live with my love, not for work reasons. But why should it prevent me from working ?

Anyway, I have read in the FAQ that some people were able to obtain a 90 day EAD at a local office. Mine said they couldn't since 10 years, they also said JFK doesn't deliver any temporary work authorization... Do you know which local offices have delivered temporary EAD?

None anymore, that practice ceased a couple years back

JFK authorizes work while ENGAGED. As soon as you marry this "temporary work permit" expires. It's not until after you receive the EAD when you file for AOS that you can work 'legally'. So- what is the point of this stamp- if you need to terminate your job while you wait 3-4 mos for the EAD.

My understanding is that many employers overlook this. Technically, from what I've read you are allowed to work on a K-1.

I've not ever read a post of a problem.

So not true... The EAD stamp expires concurrently with the I-94 not as a result of marriage.

This is new news to me- my husband stopped working when we married because I read that the EAD stamp was only valid while engaged. Hmmm- I trust your feedback- you are always on target, I only wish I would have known this then :(

Have you applied for an SSN? While worrying about something you can't do right now, i.e. work, you might think about taking a train or if you prefer, driving to your local SSA office to apply for an SSN.

Yes, I already had one. I studied in the US 4 years ago. By the way I wonder if I have to do anything with SSA, maybe tell them I am back with a K1 visa?

You wont need to deal with SSA until after getting a green-card, at that point you will want to visit them and update your immigrations status.
