tax question

After reading a post in the Removing Conditions forum, I realize I may have made an expensive mistake in doing our taxes this year. What else is new??

I filed using our son's ITIN number, which means (I think) that we won't be able to get the rebate that would apply to him if he had a regular SSN. I was under the impression that he can't get an SSN yet. He is 12 and is a Conditional Permanent Resident; we will be applying to remove conditions in August of this year. So I have a couple of questions:

1. Can a K2 child with a 2 yr greencard get a SSN?

2. If we get him a SSN, can we file an amended return?

3. If we file an amended return with the SSN, will the IRS increase the rebate or do we just get one swing at it with the initial return?

Thanks in advance for any help!!

Your 2 yr. old should be okay to get a card.........

Additionally, this is not a one time deal, and if you're owed more than what you get in rebate, then there's a procedure in place to get you the balance of what you're owed. Unfortunately I don't recall the details.

Do I need a number for my child?

Applying for a number for your child is strictly voluntary. However, if you plan to claim the child as a deduction on your income taxes, you'll need to get him or her a number. Hospitals are making it easy to sign your baby up when you complete his or her name papers, but you can also wait until later and apply directly to the SSA.

It's a good idea to go ahead and get SSNs for your children -- you'll need them if you want to open savings accounts in their names, get them medical coverage, or let them take advantage of government services. Most people today receive their SSNs at birth, and, as a parent, you will certainly encounter many forms asking for your child's SSN.

1) You are eligible for SSN if you are work authorized irrespective of age. A greencard (regardless of expiration date) is work authorization. My K-2 11 yr old has a SSN.

2) You certainly can file an amended return.

3) I don't know

YMMV

Thanks guys!

We'll go try to get him a SSN, and then file an amended return with the SSN instead of the ITIN (and probably a letter detailing why we are doing that) and hope for the best. It's worth a shot for the extra $300!

Appreciate the info...

Maya
