Hello everyone,

I am reading all about the income of the petitioner, and I'm somewhat confused. The petitioner (me) only needs a letter from employer, or I need both letter and tax returns for last year int the K1 packet?

You do not provide any support info to USCIS when filing petition to USCIS for the VISA, it is needed much later at the visa interview at the consulate.

You will be sending I-134 + financial evidence to your fiancee to bring to consulate for visa interview.

One thing about I-134, the directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134 signed and notarized.

  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% or (100% for military) of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

You may want to read the K-1 guide it spells out exactly what is needed to be sent to USCIS.

hi ronnieP. have u received ur noa2? are u preparing the affidavit of support for your fiancee's interview?

you can download the I-134 (Affidavit of support).. it has instructions on what you need. it does include the letter from the employer. if the income is not enough, you may also include bank statements, assets, etc.. the detailed instructions are in the I-134 form.

i think it also depends on your fiancee's country. in the philippines, they will be asking for the latest federal income tax return and w-2.

That is correct all. I am getting my documents together now, and didn't want to overlook anything. I thought the I-134 went with the initial packet to USCIS.

we were told if we sent in the financial information and proof as well as employer letter it would be out dated before it got out of csc or what ever service center that u file at i think from what i remember all that can only be a month old.......i could be wrong wont be the first time....lol and probably wont be the last.......but thats what i remember when filling out the k1 forms u only send those thing when it is interview time.......just be sure and send supporting documents of ur relationship and having met with in the last two years as well as any divorce papers if u have been married before.........good luck and i hope ur journey is swift and problem free

I UNDERSTAND WHAT THE GUIDE SAYS, YuAndDan, as I stated in my first post, I didn't want to overlook anything. AGAIN, thanks for you help... i guess.
