MY wife;s conditional residency expires in a month time. My son was born last October here in USA, ( US citizen),do we write his name in part 5 or not/ Those who had or has similar experience help me out.

yes, you write his name....

and make sure and include a copy of his birth certificate along with your other evidence...

i have a daughter born in july. i had called the customer service to find out if i should write her name in part 5. i was told it doesn't apply. it is for children who immigrated with you.

hmm, i don't know -- i included the name of my son and put citizenship as "US citizen"; i think it's best to err on the side of too much information, rather than too little.

well i have 4 children from previous wife, what they have to do in removing condition. thats why i had called the #800 customer service. they told me that is about children if they have immigrated with the spouse who is removing condition. i had spoken to two different customer service persons. may be both of them gave me wrong info.???

hmm, but on that part there is a spot to check if the children are living with you or not....

and it also says this " If in U.S., give address/immigration status"

I would err on the side of caution and list all your children.....

I would put more faith in what a homeless guy living under an overpass tells me than what the customer service number tells me.

The petition asks for "all of your children." "All" certainly means "all," not just those from previous marriages or what have you. We listed both of our children and indicated they were US citizens. What's the big deal about including them anyway, even if you believe you don't have to? They're not going to deny the petition or send an RFE because you told them more than they needed to know . . . .

i read this section is being about the children of the petitioner (the person who is removing conditions), not USC. If USC has children from prior marriage, these children are not "your" children for the LPR. But if LPR has *any* children, I would include them all, as per the instructions.

yeah it says "include".. it doesn't say "just include".......

on the actual form it says list all your children...

and like kc456 mentioned you just need to include the petitioner's children not the USC's...

Read the instruction on page 1, it clearly states make sure to include any conditionl resident children applying with you in order to have their conditional basis removed, or they may file seperately. I just verified this from customer service too.
