Ok - I'm almost ready to send off my Affidavit of Support to my fiance, but one last question...

I work for my father's company, and while it is a full-time, permanant position, I work as an independent contractor, meaning nothing is deducted from my paycheck and I instead receive a 1099. It is a small company, so my father writes the employees company checks - there is no formal payroll system, so I don't have any pay stubs. He said he can create pay stubs that reflect my income - but is that necessary? My income tax returns reflect, for all intents and purposes that I am a self-employed independent contractor.

So...pay stubs or no?

So...pay stubs or no?

If you are a 1099 employee then technically you are self employed and you are contracting yourself out to your father. Follow the instructions for being self employed and you should be alright. No idea what a commercial rating concern is but you should have a copy of your last tax return.

If you are filing taxes as self employed and you are saying that you are self-employed on the I-134 then do not bring any documents that say you are part of a payroll, IMO a pay stub would give the impression that you are not self employed.

No.

One tax return (complete with 1099 etc.) at minimum. Three if possible.

Facts are cheap...knowing how to use them is precious...

No.

One tax return (complete with 1099 etc.) at minimum. Three if possible.

Ok. I do have a statement from my employer (my father) stating that I have been permanently employed on an independent contractor basis since 2005, and stating my gross income, etc.

On another note, I worked for another company as an independent contractor, and was on pay-roll (had pay stubs etc), but they just didn't deduct anything from my paycheck and gave me a 1099 at the end of the year. So, I guess it is possible to be employed with a company as an independent contractor and be on their pay roll, but still technically be self-employed.

So, I guess it is possible to be employed with a company as an independent contractor and be on their pay roll, but still technically be self-employed.

The fact that they gave you a 1099 means you were a contractor. (Yes you get paid with checks that may be the same as regular employees- but your pay is based on your contract and you are not subject to the same rules as an employee.) Who did your taxes? Did you end up paying bunch of moneys for Social security (both your and the employer's portions?) That would show you are an independent contractor. Good Luck
