Filing I-130 and K-3 at the same time

Based on the topic by SPSGuy http://www.visajourney.com/forums/index.php?showtopic=115855, I wonder what would be the likely outcome If I file concurrently an I-130 and I-129F in the same package to the Chicago Box.

Your guess is as good as anyone's...do you want to waste the time in case they're both rejected and then have to resubmit? No where does it state to file them concurrently... it's a crapshoot... good luck...

I'll give 3 to 1 odds on that bet, meaning I think concurrent filing will succeed. For the several hundredth time though I'll say....

If you want an immigrant visa, don't file an I-129F for spouse.

I think most people understand they won't be applying for an immigrant visa, but rather would like the quickest way to be united.

The issue isn't weather or not they want an immigrant visa, but weather filing together would delay the K3 process.

I personally believe you should follow the instructions and wait for the NAO1, and then file the I-129F.

That's the safe way. How many things in your life do you want to bet on a stranger's 3 to 1 odds? :blush:

The reason I keep repeating the same advice is there are so many people out there that still don't understand, even after 18 months that running two visa processes in tandum is no longer the norm. One should expect that filing the I-129F for spouse will kill the immigrant visa possibilities and make an informed decision about it.

February 1, 2008.......Marriage Registered in Urumqi

February 4, 2008.......Ceremony and dinner at Hotel

March 6, 2008...........I-130 sent to Chicago Lockbox

March 7, 2008...........Received at Chicago

March 12, 2008.........NOA1 on I-130

March 18, 2008.........I-129F sent by overnight USPS

March 20, 2008.........Received at CSC (so much for overnight!)

March 21, 2008.........NOA1 on I-129f

March 25, 2008.........Both cases Touched

May 9, 2008..............I-130 and I-129F Approved!

May 12, 2008............Email notice that both petitions were approved!

May 17, 2008............NOA2's arrived by mail

May 19, 2008............NVC recieved

May 21, 2008............Leave NVC for GUZ

May 26, 2008............Arrive GUZ, waiting at Customs

July 2, 2008..............Papers FINALLY our of "CLEARANCE DELAY"

July 3, 2008..............Out to DHL Facility (?)

July 3, 2008..............Consulate received

July 20, 2008.............P3 arrived

July 20, 2008.............P3 returned to Consulate

Then you've made an informed decision.

My statement was...

If you want an immigrant visa, don't file an I-129F for spouse.

You want a K3 non-immigrant visa and it will be several months faster through Guangzhou, so good luck. You did the same thing I did and would do now as well, if I were starting now through China. My choice was and would be an informed one too.

There are several people who have done this and have already been approved. One of them being a member called ColombianoGringo.

If the reason you're thinking of doing it is to get a visa interview faster at the US embassy in Bogotá, don't bother. CR1/IR1 visa petitions are taking just as long if not less time than K3s now that the NVC started processing online payments. Please read the National Visa Forum for more info if interested.

Really? Can anyone else corroborate this statement? CR1's are taking the same time as a K-3 in terms of getting an embassy interview?

For over a year now K3 visa petitions have taken about 1 month less than CR1/IR1 petitions going through the US Embassy in Bogotá. Mainly because CR1/IR1 petitions have to be processed at the NVC for about 2-3 months before they make the interview appointment with the embassy. This NVC process has been cut down by half since people have been able to pay and dowload the necessary forms online during the past few weeks. K3 visa petitioners still have to deal with packet 3 before they can get an interview. So in the end, most CR1/IR1 petitions will take just as long as K3s, if not faster for sure.

The way things are now I'd shine on the I-129F and go with the I-130 solo all the way. CRs are MUCH< MUCH better visas.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!
