Ok, this is probably a stupid question but I dont think Ive ever gotten a clear answer on this or heard what other people are.

I mailed my wife's I-130 application on December 21st 2008.

I used tracking and saw that my application arrived three days later, 12-24.

I got my NOA1 on 2-13-08

When I read online it says that "On February 6, 2008, we received this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, and mailed you a notice describing how we will process your case. "

So which is it? Am I a December filer or a freaking Febuary filer?

I think I've read somewhere that USCIS goes by NOA1 thats when they start the 180 days thing.

If that's the case I'm freaking PISSED AGAIN!!!!!!!!!!!!! I want to hit something.

Received NOA2 approval email........May 1st 2008

May 6th 2008 : NVC received & case# generated

May 15th 2008 : NVC generated & mailed DS 3032 & AOS Fee Bill

May 28th 2008 : DS 3032 Sent (E-mailed / Auto Response)

June 4th 2008 : AOS shows PAID on website, THEN REJECTED twice

June 11th 2008 : AOS bill finally accepted. Shows PAID on website.

June 25th 2008 : Paid $400.00 IV Bill

June 26th 2008 : IV Bill shows PAID on website.

June 30th 2008 : Mailed DS-230 package to NVC.

July 11th 2008 : Called NVC. Automated message stated CASE COMPLETE!

August 8th 2008: Called NVC and spoke with operator. She stated Sept 29th at 9am is when the interview is scheduled for.

Sept 29th 2008: Wife had interview. Medical exam was about to expire before our flight so we had to get another one. Mailed it in to the embassy and got wife's visa a few days later in the mail.

Oct. 20th 2008: Wife, daughter and myself arrive back in America. POE took a whole 10 or 15 minutes.

Oct. 21st - forever: Happy to be with my wife and baby girl.

Good luck everyone!!! Stay strong and don't give up!

Your 180 days would begin February 6.

Is there a date on your NOA1 that says something like "Received date" on the actual receipt? Like mine for example says Received date: January 11, 2008 and in the box below it, it says Notice Date: February 8, 2008. That is the date that my online case says, but on the NOA 1 it clearly states is was received in January. I think you are still a December filer, I would call to make sure.

08-14-2008- Approved!!! 216 days...

08-21-2008- NOA2 Hardcopy received

08-27-2008- NVC Receives file, NVC Case Number issued

09-05-2008- AOS Fee Bill and DS-3032 Generated

09-06-2008- E-mailed DS-3032 to NVC

09-11-2008- Received Hardcopy of DS-3032 and AOS Fee Bill

09-15-2008- Mailed Hardcopy of DS-3032

09-16-2008- Paid $70 AOS fee online

I was told that mine would start in december, by USCIS

Here is my story. I've lived problem free life, payed my taxes. One day I decided to marry this girl. But to do so would require her to come to US of A, and so it started. My problem free live turned in to free problems from USCIS! Sure things turned to unsure, certain dates turned to aproximation within months. All logical thinking was out the door, as I filed my papers withing famous Vermont Centre!

Is there a date on your NOA1 that says something like "Received date" on the actual receipt? Like mine for example says Received date: January 11, 2008 and in the box below it, it says Notice Date: February 8, 2008. That is the date that my online case says, but on the NOA 1 it clearly states is was received in January. I think you are still a December filer, I would call to make sure.

I dont have my NOA1 with me here. Its at my apartment. Ill check tonight and let you know.

Amastar, I think everyone's online status uses the date that the NOA1 was processed and mailed out to you (including me). However, I've spoken to USCIS and they definately have the date (in my case) on the system stating that the petition arrived in January, even though the online system states February sometime, like yours.

I'd call them if you can and double check you're in the system with the date your petition arrived, as a few people on here have only had their NOA1 dates in the system as the arrival date, and some have had their true dates.

This is just more rubbish that you don't need to deal with while your lovely pregnant wife is with you ... hugs for both of you x

If this is the case Pushbrk, then there are going to be a lot of very angry people, as those who filed in August/September/October/November etc all have NOA1 dates of December/January 2007. If Pushbrk is correct, we really are all barking up the wrong tree thinking the 180 days starts from filing date .... this suggests it's starts with your NOA1 date ..... hmmm .... another reason maybe why VSC is dragging their heels as the mass NOA1's went out in January/February 2008.

Hi Cat, the 180 days is the 6 month wait it's supposed to take for your petition to be approved ..... but as we know most don't wait that long.

After you wait 180 days, you're supposed to be able to file an expedite to have your case looked at immediately. Sadly the processing dates recently have gone from 180 days to a lot longer and therefore you can't apply for that expedite until you reach the processing date .... that's why everyone went bezerk when they saw the recent processing dates as currently we'll be waiting for at least 9 months in some cases before we should see approval and if not, we'd then be able to apply for the expedite.

All a bit ####### really .... but as we all know, most approvals are coming in way under 6 months .... though VSC is asleep at the moment.

Ilya, I'm in the same boat as you .... I was told the processing date starts when your petition arrives with USCIS.

180 days is not necessarily how long it takes to adjudicate a petition. It is the number of days in a standard they use. They just won't do any official inquiry on your case until 30 days after the 180 days.

Petition adjudication takes as long as it takes, whether 30 days or 300 days.

Facts are cheap...knowing how to use them is precious...

Pushbrk sometimes you sound like you work for USCIS. If that is the case, maybe you could let the guys on the USCIS helplines know this information as I, like a lot of people have been told by USCIS that the 180 days starts from when they receive the petition, not from the NOA1 date.

This sounds a little mad to start it from the NOA1 date as most of the latter third of 2007 filers didn't receive their NOA1's till late2007/early 2008. Therefore it would follow on that there would be a clump of approvals (and not much before) when the NOA1 date becomes current .... in about 6 months. This does not seem logical in the slightest.

Totally Agreed!

Why should we suffer for their innability to keep organized provide service that is advertised, and be reliable. If all of my paperwork is in order sent in November, proved by my USPS receipt, what else is there? Why should I be counted when they entered my claim in the system(measily 2 months later) ? I am sorry I dont have 60 days to just throw away, im gonna claw for every hour.

Reality is reality. The 180 days is a standard to protect them from petitioners bugging them, not an estimate of time to adjudicate a petition. We've seen some recent 30 day approvals. 60 to 90 days is pretty common too and I expect we'll see more and more of them now that the service centers are caught up from the "beat the fee increase" rush of last summer.

That said, my I-129F took about 85 days and a friend's filed near the same time took 28. Filing to interview, our process was still 2 days faster than theirs going through the same Consulate. NOA1 to NOA2 is just the beginning of the visa process and it's best people understand that from day one.
