Yes they will need a waiver, that is why I posted the link to Laurel Scott on youtube that explains what you must do. Also check out immigrate2us.net for waiver information and sample hardship letters.

Aye Aye, If she marries a US Citizen, she still has to go back to her home country, apply for a fiance's visa and come back legally before marrying. Then after the marriage, apply for adjust of status.

Not True

If she marries a US Citizen here, she does not have to go back to her home country for anything. She stays right here in the U.S.

They will go through the interview process here and must prove that she and the man she married is a legitimate marriage.

I know of at least 3 people who outstayed their tourist visas, eventually married and got their green card.

That is why it is so hard for young unmarried women from countries where poverty and jobs are not easily found to get a tourist visa.

AOS / EAD / AP and Remove Condition

3/06/06 - AOS/EAD/AP process begins

3/31/06 - AOS/EAD/AP package Fed Ex'd to Chicago

4/03/06 - AOS/EAD/AP package signed & received

4/10/06 - NOA1's received for AOS, EAD and AP via U.S. Mail

4/11/06 - All 3 checks cashed / $745.00 poorer but worth every penny

4/27/06 - Receive Biometrics appointment letter scheduled for 5/11/06

5/11/06 - Biometrics completed

6/02/06 - Receive notice that AOS only has been transferred to California to speed things along

6/07/06 - E-mail that AOS received in California

6/13/06 - Welcome letter mailed by California... yeah baby

6/17/06 - Official welcome letter received and card will arrive within 3 weeks

6/19/06 - Card arrived in the mail.......

3/08/07 - Trip back to Peru for 10 days and our Religous Wedding

3/2007 - We're Pregnant

12/19/07 - Sebastien Joshua born 8:29am 7lbs 2oz 19.5"

3/14/08 - I-751 Removing Condition is in the mail

3/20/08 - Checked cashed

3/17/08 - I-751 Package signed and received

3/24/08 - Case moved to Vermont

4/17/08 - Biometrics completed

4/21/08 - Touched...........

6/16/08 - Touched once again........

11/3/08 - Touched again.. this is begining to feel good

03/16/2008 Received RFE I-130

03/26/2008 RFE for I-130, sent to LA Through USPS Certified mail

03/31/2008 I-130 RFE response letter is received

04/09/2008 I-130 case processing has resumed

04/17/2008 I-130 APPROVED!!!! DATED 04/14/08 YAY!! 7 monthes to approve.

I-485 & EAD

03/13/2008 Sent I-485 & EAD to Chicago Lockbox through USPS Priority Mail

03/16/2008 I-485 & EAD Received by R. MERCEDO USCIS Chicago IL

03/25/2008 Received NOAs for I-485, I-765

03/28/2008 Received Biometrics Appointment Notice

03/29/2008 Biometrics done-Appointment Scheduled 4/05, but I went early.

03/31/2008 Case Status shows up Online

04/03/2008 EAD touched

04/10/2008 RFE for I-485 received today, dated 4/04/08

04/11/2008 Sent RFE to Lee's Summit, MO / USPS priority mail

04/14/2008 USCIS received RFE response; signed by C BORDERS.

04/17/2008 Case processing resumed

04/22/2008 Touched

05/09/2008 Received EAD Approval Notice from CRIS "Card production odered"

05/14/2008 EAD card production ordered, 2nd notice

05/16/2008 EAD Approved & Sent!! (61 days)

05/19/2008 EAD in hand!!!!!

They will go through the interview process here and must prove that she and the man she married is a legitimate marriage.

That is why it is so hard for young unmarried women from countries where poverty and jobs are not easily found to get a tourist visa.

She was an EWI not an overstay.

According to INA/immigration law, it is NOT true. Anecdotes do not help someone if the INA completely contradicts it and every source on the subject says the completely opposite. "Someone I know" does not help the OP.

At this point, I am just going to say for the OP to speak to an attorney and not listen to meaningless anecdotal evidence that can't be backed up since we do not know what "someone from Colombia"'s story or details were.
