Hi VJ family i need your help first i will tell you what happend today,

I got to the EMB very early 7:00 my APT was at 8:00 i was the second to interview she reviewd my papers everything was ok until she look at my x divorce there was a probelm and i thought it wont t be as my lawyer told me, I had a Previous marriage when i was in the states and i came back to my country jordan cause i was deported i tried to contact my wife while i was in Process of deportation she didnt even care she left me so she didnt deserve me so when i came back to jordan i confirmed my divorce in jordan in 1997 then i got married in 2005 in jordan and i have a beautiful family baby boy from my current wife and she is American allso iam so happy with them when i went today to the embassy they told me that I married my x wife in the states then I have to get a divorce there i tried to tell her that if you recongnize a Foreign marriage why dont you recognize a Foreign divorce and i told her i didnt have a chance to divorce her there i was deported on the seen

the deportion is not a problem cause iam done with the period its more than 10 years now.

so she said they will take my papers back to the Immigration and then the Immigration will take it to the state i was married my x wife in which is newjeresy and they will look for a law that permit what i did her in jordan as if its legal to divorce her in a Different country i mean that i divorced her in my country.

Knowing that i went to the embassy back in 2004 and i talked to one of the officers about what should i confirm my divorce in jordan she said that i have to do 3 steps in order to be ceear from this marriage and i did it and now they wont Recognize it

I dont know what to do iam so down and so helpless i know i did mistakes but i want to start fresh now i need help

if someone need more details to help i can give more thanks...

Sorry that things got complicated.

It seems that they haven't outright denied you a visa - I think they just need the proper documentation to move your case forward. I was wondering how in the world you got an approval by the USCIS and the issue of the divorce papers wasn't addressed before the case was moved to Jordan. Hope that your current wife is able to contact and attorney in NJ and see if this situation can be resolved.

I'm sorry I don't have a real advice but I feel that this is a question for a person with a law degree.

I can't really offer good advice. I just wanted to wish you good luck and I hope you receive your answers soon. Try to stay positive. You and your wife are going to need to lean on one another while you wait.

Sending you my prayers. It will work out. We are on AP as well. It takes some time but people do get out if it.

Samer.......Salam u alaikum...Im so sorry to hear about this problem...my thoughts to you is to contact the city and state you were married in. In the USA its easy to obtain information such as marriage certificates and divorce decrees. All you need is the date of the marriage and the names of the couple. If your ex obtained a divorce after your deportation it will also be listed on your old marriage certificate. Your new wife can easily obtain this information and request copies. Good luck and inshaAllah all this will work itself out.

Perhaps your wife can contact either her congressman or senator. It doesn't sound like it was actually denied since it stated that it was under AP. Did they request further documents on the divorce? I am not sure if they just questioned it deeper, but accepted the divorce or if it really is an issue. Hopefully your wife can have her representative get to the bottom of it.

AP stands for Admistrative Processing. It is a normal security check that almost everyone has to go through. If it didn't say on the 221g that is has been sent back to the USCIS or if it didn't ask for more documents I really think you don't have much to worry about, just normal security checks. That would be the best news ever, I hope that is what it turns out to be.

When I had a problem - I spoke to an attorney here in the US.

The legal system here - would have worked to divorce like you have done in your case. I could have had a full divorce, or an annulment, my choice.

I, actually, chose to sign a POA form & have the divorce handled by a relative in Jordan. Worked out fine.

But, you should be able to do that in a different country - the legality of a marriage carries across national boundaries. Like someone said in another post - you don't get magically unmarried when you go on vacation abroad.


The moral of my story: Stick with someone who matches your own culture.

( This coming from an Arab who married an Arab from overseas... go figure. )

It sounds like a standard AP but I'm concern if the issue of the divorce has been resolved or if you still have to provide them additional paperwork regarding it's validity. If it's only the AP - then you are almost done but you never know if the divorce issue won't come up during security checks so I would advise that you resolve it to cover all you bases.

If that is all it states I think you are pretty safe. But since you feel it was an issue about your divorce I think I would still contact the congressman/senator. They can email the consulate and ask about it. They will let them know if it could be a problem. All in all I think you are okay.

Wow so sorry to hear this, but really I think they are right, this does not sound like a denial. Keep going you are almost there. Keep us posted. It will all work out, I feel that for you.
