Hi

I was just wondering if the 90 day waiting period for the EAD starts from the NOA1 or the date of biometrics?

03.04.2009......Posted I-130 to U.S. Embassy

03.04.2009......Ordered Police Certificate for Visa Purposes from Local Garda Office (ordered over the phone)

03.05.2009......I-130 received at Embassy

03.06.2009......Received Police Cert

03.18.2009......I-130 Approved

09.10.2009......Medical Exam

09.23.2009......Embassy receives Notice of Readiness

10.13.2009......Received our interview date

10.29.2009......Successful interview!

11.5.2009........Visa received in post

11.7.2009........All the family flew to the US together :)

12.20.2009......Received Welcome to America letter

12.24.2009......10 year Greencard received in the mail

Before you go find the web site that states an interm EAD will be issused after waiting 90 days and print out the page and take it with you because some Offices will tell you it is 90 from biometrics.

It states on the receipt that it is 90 days after filing. We got our Interim EAD without any hassles. It's worth trying. Oh and we were told it is after the biometrics too when we went to do the fingerprints but we went with out gut feeling...good luck!

There is NO consistency here.... some offices use 90-days from biometrics and others use 90-days from application!

Thanks for all the info, I'm only on Day 53 from NOA1 so hopefully won't have to go for an interim EAD, but just wanted to be prepared for all eventualities!

It's the 90 days from the *receipt* by USCIS, which is about 5 days ahead of the NOA date. Receipt date is on the NOA as well. 90 days from biometrics is BS; if someone is getting this line they should ask for a supervisor.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

oh yeah I almost forgot, Silvia got her EAD on day 94-96 we forgot to check mail for a few days and did not find it until the monday before Info Pass appointment

Does anyone have a link to the above text on the USCIS website? or anywhere offical so that i can print it and take it with me?

6/21/2006 - sent i130.i485,i131,i765,biometrics, sponsor

6/23/2006 - recieved by MSC

6/27/2006 - notice date on NOA

7/26/2006 - fingerprinting

recieived notice for interview... duno when

9/2/2006 - all apps touched

9/13/2006 - interview. waiting for bkground, no approve.deny case will be reviewed as my case in more complicated., i1131, i485 sepereated from file, claimed that they will be sent for processing

9/22/2006 - called national customer support., been 90 days, no interim ead (i knew i wldnt have it yet) was told to go to santa ana

9/26/2006 - office claims file is floating around somewhere in the mail room, they will find my work permit app and travel doc app and send it for processing

9/26/2006 - drive to LA to double check what they said, office at LA claims that santa ana sent work p, travel to NBC

9/27/2006 - EAD, Travel docs touched

9/28/2006 - EAD, Travel docs tocuhed

9/29/2006 - :( nothing touched, no letters no emails :(:( ---- waiting., will send letter to congressman monday

10/2/2006 - Travel Docs Touched, nothing new on EAD....Wife sent letter to congressman

10/2/2006 - Got Travel Doc in the mail

10/2/2006 9:30 PM PST, 5 email ead approved, will mail me new card

10/6/2006 10:30 AM PST, got 3 emails saying that they have mailed out an approval letter for my EAD... hmmm wheres the damn EAD,

10/7/2006 - Got EAD with a TYPO in a#!!!! in the mail

Open to interpretation - some DOs and SOs count from the Receipt Date, others discount the time until the biometrics have been done.

The folks at the southern end of your state, at the LA DO, disagree with you - including the supervisors.
