How can you tell him that? they wont tell you they denied due to age but ....

A friend of mine is in the same situation. He's 25 and shes 44. He's worried he will get denied due to the age gap, but i have told him they wont deny him.

That and two bucks will get you on the New York subway. Visas are never denied because of age gaps but age gaps can cause extra scrutiny of bona fides. Sometimes the relationship bona fides don't stand up to the scrutiny and the denial is for failing to convince a Consular Officer the relationship was entered into for more than to derive an immigration benefit.

All that said, UK, Austrailia and many other "Western" countries just really don't get nearly as much scrutiny as the high fraud regions or countries do.

I'm always amazed that most posters of such questions fail to indicate who is older though. Cultural values are a definite consideration by Consular Officers. For instance a younger Indian/Hindu man marrying a significantly older woman is so out of the ordinary, the likelyhood of success in the visa process is significantly reduced.

No worries. My friend (male) married a 54 year old woman 2 years ago. He was only 24 when she filed for him. They're still married and they had no problems at the interview. The only thing the CO was (WOW! I can't believe you're 54 -- you look much younger) asked them a few more questions and wished them a happy life together.

I also share a large age gap with my fiance 13 years (I'm older USC -female). I was worried about it at first, but I'm over that bridge now.

They cannot deny you because of the age gap, but they can rake your case over with a fine tooth comb. Just build a solid case and you should be fine, as others have mentioned.

My husband and I have a large age gap as well. We had problems getting him here and we were initially denied. We overcame the denial, but it was a #######. So let me give you a run down. No they can not deny you for the age difference, but I guarantee that they are going to go over your case with a fine tooth comb. One tiny little bug can cause you problems. Your fiance is from Australia (if I remember correctly), so I doubt they will be as hard on you as someone from a high fraud country. But still, be prepared.

Go over any and all red flags. Ours was that he has a sister here, and they thought she paid me. Duh!! you can't pay me enough money to do something illegal! We took plenty of proof to the consulate, but once they found out about his sister they didn't bother looking at any other evidence.

So if I was to do it again (and mind you I won't..lol) I would send a letter with the I-129f petition. In this letter I would address the age difference, as well as any other red flags. I would also have your fiance do a letter as well. I would also include letters of support from any family or friends that know you as a couple.

You've received some very good advice here. My husband and I made it through the immigration process and not once did they question our large age difference. I figured it might be because his mother was 13 years older than his father. But to be on the safe side, address it before it is an issue. If they want to deny you, they can and they don't have to state it's because of the age difference. I wish you the best of luck and a quick bump free journey.

Still waiting for our cards...Had to file I-90 as they sent them to the wrong address.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

Some people have had problems but if you have a bona fide relationship and can prove it, you should be fine.

There are many couples here on VJ who had successful visa journey's with significant age gaps.

There is almost 10 years between me and my husband, he is 35 and I'm 25 and we didn't have a problem with getting the Visa with our age difference. You will be fine, just prove you have a bona fide relationship and you will have no problems. :thumbs:

11/10/08 - Removing Conditions - Sent package out!

11/19/08 - Received Notice of Action - 1 year extension on my current green card - now waiting for biometrics letter.

11/28/08 - Received biometrics letter.

12/12/08 - Biometrics appointment - 10am.

01/13/09 - Still waiting............

06/08/09 - Card in production and on it's way!

06/22/09 - Received 10 Year Green Card! YAY!!
