Hi everyone,

I'm a Chinese citizen and also a student in Sweden. I got my NOA2 on March 12th. And the case has already arrived in Sweden, but now the Embassy in Sweden requires me to be a permanent residency in order to deal with my case. But I only get student visa here. Because I live in Sweden, I thought it would be OK to go through the case in Sweden.

Will the Embassy forward it to China or back to NVC? How long will it be delayed? What can we do now? I'm feeling so sad now, being apart with my husband almost one year, now something wrong again. I don't know what to expect now, tears on the face.

Here did you marry? China or Sweden?

Typically:

I-130 of IR1/CR1, it will be processed in the Consulate that has a jurisdiction in the Country of your residence.

I-129F or K3 will be process in the Country where your marriage took place.

Typically:

I-130 of IR1/CR1, it will be processed in the Consulate that has a jurisdiction in the Country of your residence.

I-129F or K3 will be process in the Country where your marriage took place.

We got married in US.

Then the consulate in Sweden may be correct, you need to be in Sweden on a resident visa. Request that they send the case to Guangzhou China.

I would also contact DOS Visa services and see what they can do for you, and explain the situation.

Lastly, if this goes to Guangzhou, you will want to join "A Candle for Love" That site specializes in immigrations through that consulate. http://candleforlove.com

Delay, Guangzhou is a very busy consulate (1 immigrant visa consulate in a country with 1/4th of the world population) typically GUZ takes 2-4 months to receive petitions sent to them. Though your case is unique they may process it quicker due to case already handled by Sweden.
