As a K3, yes you can. It's much more expensive to file for them separately though.

You have to have the EAD to get the SSN as a K3.

Yup

Its 350 for the ead right? I wish we could do together but he is bored out of his mind and wants to work NOW. So I figure its good so he can help pay for the aos. Do u know how long the permit is good for?

I think the permit is valid for a year...but don't quote me on that. It may also be when his I-94 expires.

I believe that if your EAD is filed before you AOS the EAD does expire when the I-94 expires. I know that is how it works for the K1, not 100% sure that is how it works for the K3.

You're actually correct. The EAD will expire when the I-94 expires. For a K1, the I-94 expires 90 days after arrival at port of entry. But, for a K3, the I-94 expires when the K3 visa expires (usually 2 years). So, it is ok to apply for an EAD while on a K3, especially for those who want to wait until it's closer to their 2nd anniversary before filing for AOS so that they won't have to file for removal of conditions. The EAD, after all, is cheaper than the I-751.

Also- if you file for AOS later on before the K3 expires and closer to your second anniversary, you'll get the 10 year greencard instead of the 2 year. You can avoid having to remove conditions.

That's what we're doing and the fee is $340. This way he can work and earn the money to pay for the AOS which is over $1k *and* as people have stated he can get the 10 year card if we file close to the 2 year mark.
