Tourist Visa

Good Evening VJ Members

I want to explian my situation and need your help, I have couple questions :

First, My Situation :

I am Syrian man and married to US citizen

We are both living in a third Country ( Philippines where my wife is working ),and we applied for immigrant visa in US embassy in Manila on Feb,6,2008 Through DCF and we were informed that we will get answer for our petition within 6 months- 2 years and we have no problem with that because we are not planning to live in USA .

But, summer vacation is coming and my wife's parents want to meet me and I want to meet them and spend the 1.5 months vacation in the states .

So i applied for tourist visa and am scheduled next month SO

MY QUESTIONS

1- will i get automatical refuse cuz i had immigrant petition?

2- i know that the consulate officers are looking for strong TIES to Philippines where i am living, but Iam not philipina , I am syrian and live here and i have ACR ( alein certificate regestriation) for Phli.and I have a bank account in the philippines

Is this enough?

3. Should my wife come to the interiew with me? Will it help?

CAN YOU HELP GUYS ?

The fact that your U.S. spouse is residing permanently in the Philippines will probably help your case for the tourist visa. Your application for an immigrant visa may have the opposite effect. Why are you trying to get an immigrant visa if you don't plan on being a resident of the U.S.? Immigrant visas are for those that plan to reside in the U.S.

05/01/2006 Biometrics Appt.

07/12/2006 AOS Interview APPROVED

07/24/2006 GC arrived

05/02/2007 Driver's License - Passed Road Test!

05/27/2008 Lifting of Conditions sent (TSC > VSC)

06/03/2008 Check Cleared

07/08/2008 INFOPASS (I-551 stamp)

07/08/2008 Driver's License renewed

04/20/2009 Lifting of Conditions approved

04/28/2009 Card received in the mail

The fact that your U.S. spouse is residing permanently in the Philippines will probably help your case for the tourist visa. Your application for an immigrant visa may have the opposite effect. Why are you trying to get an immigrant visa if you don't plan on being a resident of the U.S.? Immigrant visas are for those that plan to reside in the U.S.

Really i don't know , why we went to the immigrant visa directions

may be because i and my wife are not good in choosing the correct visa ( after awhile , i knew K3 visa is the suietable visa for me )

can i cancle my immigrant visa I-130 petition ?
