This is not for me but for a co-worker. She will greatly appreciate any help anyone can give on this issue. She came here in January on a K3 visa and is at odds with her husband. He is telling her she can't work on her visa and that if she does he will turn her in and she will be deported. He has become very verbally and psychologically abusive towards her. I am familiar with the K1 visa but not with the K3. I am guessing that since she is here on K3 she should have obtained her green card and work permit on her enterance? Can anyone advice me on specifics, and also where she should go to talk to someone from immigration about her situation? Would an infopass appointment be appropriate for this? Thank you in advance for any advice!

She cannot work on the K3 until she files for work authorization. Her K3 only allows her to travel it is multi entry visa.

Mary is correct. Your friend must file for Adjustment Of Status and an Employment Authorization Document. She cannot work until the EAD is received. It typically takes 3 months from filing until the card arrives.

The woman's husband is partly correct, partly wrong.

She can work while in the USA on a K3 visa, but only after obtaining employment authorization from the USCIS. And a SS card from the SSA. She has both already if she is you co-worker?

As to her situation, she would be better of talking to an immigration attorney rather than the USCIS. But perhaps first she should talk to a family-law attorney.

No, she does not necessarily need to apply for adjustment of status.

As we are unsure of her specifics and don't really know if she's properly authorized to work, I'm not going to add anything to what everyone else has said about her working on her K-3.

However, I did want to post a link to the USCIS website regarding abused spouses. While no physical abuse has been mentioned, I think people should know there are options if that occurs.

More importantly, the link does list an abuse hotline that this woman could call for some support. I can imagine it would be scary to be in a foreign land and to be threatened by your husband with deportation. I hope she really doesn't need this info. :unsure:

I'll be more than happy to mention the things that made me come to this conclusion.

1st of all, I don't see the relationship between the OP's "work-related" question and the mention of abuse. We all know the role "abuse" plays in regards to immigration matters.

2nd of all, the OP mentions that this is not for her, but for a "co-worker," which means she's already working. The fact that the OP's wanting to know if her "co-worker" can work or not leads me to believe the "co-worker" is working illegally, w/o an EAD. So the husband is correct telling this to his wife in trying to abide by the law, while his wife is obviously disregarding it. Otherwise, if the "co-worker" had an EAD, the OP wouldn't have the need to ask her question in the first place.

3rd of all, if the OP just wants to find out if whether her "co-worker" can work or not and if she should've gotten an EAD already through the K3 Visa, she shouldn't have the need to ask if an Infopass is necessary.

4th of all, I can't see how a USC could threaten to get his/her foreign spouse deported just b/c they work without a permit. And if they do, it's again due to the USC abiding by the law, which I see nothing wrong with.

I said co-worker - she is not working with me, she is not working at all right now. She is the friend OF a co-worker. She does not understand what is happening with her case. Her husband has changed since her arrival and she is wondering what the truth of the situation is. I'm sorry this turned into a thread of critisicm and "why doesn't she just go home..." (Btw - her husband won't buy her a ticket to go home, and since she "can't" or he won't allow her to work it's a tough situation)

I was trying to avoid the probing and judgemental responses I felt I wouldn't get by asking the pertinent questions, hoping I would receive advice and not the criticism it generated. Even though I said co-worker - she's neither working with me, nor working at all right now. She is a friend of a co-worker. She does not understand what is happening with her case. Her husband has changed since her arrival so she is wondering what the truth of the situation is. I'm sorry this turned into a thread of critisicm and "why doesn't she just go home?" BTW, her husband won't buy her a ticket back home and since she can't or he won't allow her to work, it's a tough situation.

How strange! Although she at first was an OP's co-worker, she's now a co-worker of another OP's co-worker, but she's currently not working.

If I knew my marriage could be jeopardized by my immigrant spouse getting caught working without an EAD, I wouldn't allow working either. An immigrant spouse not caring about the possibility of putting a marriage in jeopardy, would show no care in the marriage at all.

My immigrant ex-wife had to return to her home country soon after she failed to obtain a GC through me.

I became a devil's advocate right afterwards.
