affavdavit of support question

Timeline

I have the AOS all filled out and ready to send.

As my wife and myself migrated from ireland we only just got a joint bank account. So we dont have a statement yet. Thats one problem. Next i rang immigration customer service and they told me any assets i have in ireland wont go towards my income of support. So that rules out our house in ireland we bought last year for 275K euro which is now worth nearly 400k dollars plus the investments of nearly 20kk dollars in ireland.

I have a letter though from my wifes employer stating when she started and how much she earns. So sia letter from her employer and a bank statment from here enough then? Its crazy that my income at home and our house cant be considered as income.

I-751 - Removal of conditions

10-20-2008 - Sent package via usps - overnite mail

10-22-2008 - Package received and signed.

10-28-2008 - Cheque cashed

12-02-2008 - Biometrics in Boston

10-03-2009 - Transferred to CSV

If you sold your home and deposited the money in a bank account in the US, you could list it as an asset on your I-864. Did you file a tax return in 2004 or 2005? You may want to get someone to co-sponsor you to be safe.

It's not entirely clear from your post who is the USC and who is the immigrant. So I will assume that it is you.

What is your "income at home"? Are you referring to the job you had back in Ireland? And are you still working for that same employer now that you're here in the USA? If your answers to the 2nd and 3rd questions are 'yes' and 'no' respectively, then of course your income back home does not count - yesterday's income does not pay today's bills, today's income does. Do you have income today? If you do, that probably would count.

As to the house in Ireland, if you can demonstrate that the house can be sold and the proceeds brought into the USA within 1 year then it can be counted.

Can't tell if a letter from your wife's employer and a bank statement will be enough - you neglected to provide the critical information that would be contained in those documents. Assuming that the missing information is satisfactory, she might need more than just the letter as documentation of her employment. Many people include a few recent pay stubs.

And she will have to provide her 2005 income tax return if she was required to file one, or a valid explanation why if she was not.

The asset (home) does NOT have to be sold to be used on the I-864.

Ok i forgot to say that my wife has been living in ireland since december 2003 so she would only have tax returns for 2003 as she had been living in ireland since we migrated home in march.

* She has 4 pay stubs so far so that should be enough. My wife earns 40k a year. She earned alot more in ireland.

* Tax returns for 2003.

* Bank statement with close to 10k.

Im not going to sell our house in ireland just to suit immigration. I dont have any income as im not allowed to work. The only income i have is the rent we get from our house in ireland.

Your wife would still have had to file her U.S. tax return for 2004 and 2005. My husband also lived in Ireland and filed his tax returns, as is mandatory for any U.S. citizen no matter where they live. As she was living abroad and will be eligible to file 2555-EZ (foreign income earned exclusion up to $80,000) she will not be penalised for her late filing, but you definately DO need these!

As for the Affidavit of Support, they really don't care if your wife was earning a million euros, it's what she is earning now in the U.S. that counts. I would look into a co-sponsor if I was you.

As for the Affidavit of Support, they really don't care if your wife was earning a million euros, it's what she is earning now in the U.S. that counts. I would look into a co-sponsor if I was you.

Agree she needs to back file, but they indicate they have assets of considerable value--Joint Sponsor not necessarily needed.

And her income is 40K/year in the US? Unless there's a boatload of dependants, that salary should be sufficient.
