need a little clarification please... if you can.

Hello everyone,

We are just starting this long and confusing paper trail, we are trying to decide which is the better way to go. We had thought our only choice was the K-1 visa, since we are not married yet, but have both been reading about the DCF. I am American, he is Australian. I was reading on the consulate website for Sydney today trying to get more info on the I-130 and trying to find if I can come to Australia, we get married and apply then. However the website is stating that for USCs that are not a resident of OZ that they need to apply the I-130 with the Immigration & Naturalization Service and the approval process may take up to 12 months. So does this mean that we can’t go to the Sydney office once married and do it all in one day anymore? Or are they saying we just need a case number and such before getting an interview… ? If anyone knows more or can explain this I’d be very thankful for the advice.

Dec 2003: Meet

Feb 2006: Start DCF

March 1st 2006: Receive I-130 packet and packet 3 in mail (AU)

March 6th 2006: Leave US for AU

April 15th 2006: MARRIED!

July 2006: Interview in Sydney AU (approved - pending fingerprints from Canada)

Oct 2006: Fingerprints FINALLY Arrive!

Nov 11 2006: Hubby comes to USA with Green Card

April 15th 2007: 1st Anniversary

April 15th 2008: 2nd Anniversary

Sept 2008: Begin I-751 to remove conditional stat.

Sept 10 2008: Mailed I-751 to CSC

Sept 15th 2008: Delivery Confirmation from USPS

Sept 20th 2008: NOA1

Dec 2nd 2008: Biometrics Appt. took all of 15 min

Dec 29th 2008: RFE

Jan 14th 2008: Send more evidence to CSC

Jan 30th 2008: Notice that 10 Year Green Card has been ordered

Feb 7th 2009: 10 Year Green Card In Hand

Timeline

You can file your i-130 petition whether you are an aussie citizen or not. You can fly in, get married, interview and get the visa all in one trip.

really....do some research - READ AND LEARN!

All the info you need....

Finally finished with immigration in 2012!

yep i read over that last night... and thought well i should back this up with some info off the sydney website... and then it just got all messy in my head! I'm thinking had i known i was going to get into all this i would have taken a law degree not and english lit degree!!!

I guess you just get to the point where you read so much you start to second guess the info...

Dec 2003: Meet

DCF isn't the official term....you can't ask sydney about DCf. In the reading that I posted above, it said that you have to write sydney and request that you, a USC, want to file the petition for your hubby...an Aussie. They write you back and say...ok.

Finally finished with immigration in 2012!
