Tourist Visa to Green Card possible?

Oh wow guys, thank you for the replies and advices, I had gotten the tourist visa after I'm married to my hubby and they did know that he is a US citizen and I had promised them that I am coming back, I was just thinking if its possible to do it all here as opposed going back and forth..but seriously I just want to do it legally and do not want to jeopardize any chances I get in order to stay here and be with my hubby,,,I will definitely talk it out with my hubby and see what he has to say..thanks again and good to luck all of you ....

What do you mean they didn't know he was a USC.. That question is specifically asked for on the DS-156. Are you saying that you made a material misrepresentation in order to get the tourist visa. Better get your facts straight, because if you try to adjust on the Visitor status, you could get yourself in a whole world of trouble...

To OP: good luck and ask for help from an immigration lawyer. Your case can get complicated...

There is nothing wrong or illegal about the OP doing AOS now she is here....she is the wife of a USC and is entitled to do AOS....

Really? What did she say at the POE? What did she say at the Consulate?

None of us are in a position to tell her what she can or can't should/shouldn't do, other than see a professional in a *private* setting where she puts out all the facts under guided questions to assess her situation.

If you google it comes up with a long list all saying the same or using INS in place of USCIS...in those google results include other US embassy sites, goa.gov website, etc Obviously it is text where references to INS has been changed to the now USCIS. Does that make information untrusty.....no, as the information included in the entire text not quoted is backed up by USCIS policy/law when it comes to AOS from a tourist visa or under the VWP once married to a USC.

Probably what Yodrak means is that it is at the discretion of the CBP, not USCIS.

Since you got married in Malaysia, I'd just go back and file the I-130 there (DCF). You already did the hard part of jumping thru the hoops (21-day stay for the USC) to get married there. Look thru the info on this site for DCF's.

It'll take longer than just staying here and adjusting status, but there are lots of good things too, for one you wont have to worry about getting denied and deported on the AOS. Also, you can work from day 1 when entering on the I-130. Considering that you could likely get an interview date there in less than 3 months, it's quicker than trying to get stuff here.

Downside is spending a few months apart, and I can see not wanting to be in KL during the haze... :P

was your marriage a ceremony or by law??? mine was at the city hall then i went back to canada, did my traditional wedding then came back. I have no problem getting my greencard. The interviewer didnt ask any of such thing.

Canadian came into United States as a visitor

11.01.05 - sent out i-765, i-485, i-130

11.16.05 - rec'd NOAs

12.27.05 - rec'd an appointment for AOS biometrics

01.02.06 - rec'd an appointment for biometrics

01.04.06 - completed biometrics & fingerprints for both AOS and EAD

01.10.06 - *touch*

01.12.06 - ead approved!!!

01.17.06 - ead card rec'd

01.18.06 - applied for ssn

01.27.06 - rec'd ssn

03.24.06 - rec'd interview date for May 02!!

05.02.06 - AOS APPROVED!!!

05-06.06 - rec'd Welcome Letter

05-12-06 - GREENCARD rec'd.
