Loterly has really a good point for this more than anyone else, She very well-explained my case here regarding my submitted affidavits. Thanks Loterly, i really appreciate this.

it was the judge himself/herself who witnessed the marital (marriage) that took place. he/she saw the marriage right before his/her eyes. she swore that he/she witnessed the marital union (marriage). becoz he/she was actually the one who "united" the 2. so the third party (who happens to be the judge who presided the marriage) gave her/his sworn statement (which is the affidavit) that there was really a marital relationship (the marriage-ceremony(wedding) that took place done in good faith (bonafide).

and the on-going relationship (which is the detailed information that u want to be included) you were referring here is written on the last part of the requirement (annex I), but u missed the word there IF ANY, AND complete information and details explaining how the person acquired his or her knowledge of your marriage. the highlighted part stated HOW THE PERSON ACQUIRED HIS OR HER KNOWLEDGE OF THE SAID MARRIAGE. and the answer would be.. that witness happens to be the judge himself/herself who knew ( acquired his/her knowledge) abt the marriage. SO THE THIRD PARTY (THE JUDGE) DOESNT NEED TO INCLUDE ANY DETAILED INFORMATIONS ANYMORE BECOZ HE/SHE STANDS TO BE THE GREAT INFORMATION HIMSLEF/HERSELF.

marital relationship is the marriage and wedding is the ceremony.

the requirement letter I only ask for affidavit.

the marriage certificate (which they also submitted) is one of the documents required to be submitted.

shape here just wanted to give everything that she has becoz it just happen that she doesnt have the following :

E. Documentation showing joint ownership or property; or

F. A lease showing joint tenancy of a common residence; or

G. Documentation showing co-mingling of financial resources; or

H. Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together

and she can only provide the letter I.

if anyone can provide from letter E to I then that would be so GREAT

with as much information and as many examples regarding dealing with the USCIS, it is odd that there are so few examples of these affadavits... we are filing our lifting of conditions and i have been looking for examples to use... i have basically used the examples in the example immigration forms here at vj and modified them to fit our situation

i am of the mindset that the more evidence i supply, the better off we are... meaning, the less chance of RFE... others feel that just give the minimum and if they want more they will ask... thats fine too...

i think that what seems to be happening in this thread is just miscommunication... i dont think anyone is purposely trying to mislead ppl...

what seems to be the point of contention is "bona fides of the marital relationship"... for me, and im not a lawyer this is just MY opinion, that means not just that someone saw me get married... i think what it is asking for is that we remain happily married, that whoever signs the affadavit affirms that we live together and are truly committed to each other... i think that is what the USCIS is looking for with these affadavits... so that 2 ppl dont just show up and get married and then never see each other again

so, you could take the examples that were provided in the first post of this thread, and add in that information... and probably have what it is that is being asked for... after we successfully lift conditions, i will post our examples if they seem to be accepted by the USCIS...

do they really do any good? who knows... what matters is that ppl who love each other and want to be together get approved so that they can be

thats just MY opinion

"True love is falling in love with your best friend,

and only then, will you find the meaning of happiness."

it has been stated clearly here... :bonk:

and that is exactly the content of that affidavit.

No, the content of the example affidavits does not address "the bona fides of the marital relationship". Instead the content is limited to content addressing the legal marriage taking place. The marriage certificate is all that is needed to affirm that. The affidavits should contain information about the relationship, not the wedding. They should be from people who have observed enough about the relationship between the parties to assist in an adjudicator concluding not that they got married (Scam marriages have marriage certificates too.) but that the marriage is between people with a bona fide relationship.

The content should address the relationship, not the wedding. To think otherwise is to misunderstand the intent of the suggestion to include affidavits.

THIS ONE IS A CONTEXT FROM USCIS >>>information and details explaining how the person acquired his or her knowledge of your marriage)

THIS ONE IS A CONTEXT FROM PUSHBRK >>> The affidavits should contain information about the relationship, not the wedding.

SO DO WE NEED TO VOTE ON WHOSE CONTEXT WE HAVE TO FOLLOW???

Shape, please, please accept my apology. I did not mean to offend you. I was merely pointing the fact that the way your affidavit was formatted was "probably" not enough. and that people who wish to submit affidavits should submit proofs of the bona fides of relationship. Not the "wedding"

Based on USCIS IR-130 filing instruction:

I. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage);

*Persons having personal knowledge of the bonafide of the relationship.

*It didn't say explain the affidavit should explain bonafide of the relationship.

For the umpteenth time, the contents need to address the relationship, not the marriage. Proof a wedding/marriage took place is covered in the "required documents" section and the evidence requested is a marriage certificate. You're missing the entire context of the suggested items. They are all about the relationship, not the wedding.

Shape, please, please accept my apology. I did not mean to offend you. I was merely pointing the fact that the way your affidavit was formatted was "probably" not enough. and that people who wish to submit affidavits should submit proofs of the bona fides of relationship. Not the "wedding"

Again, all your bolding and color and extra size ignores the actual key issue which is the "relationship".

Facts are cheap...knowing how to use them is precious...

Ladies, I think your misunderstanding what is trying to be said by some members.

Bona fide: made in good faith without fraud or deceit.

True the instructions say to explain how the third party acquired knowledge of your marriage ( attended the wedding)

the affidavit would be more useful if it contains information why the person feels your relationship is genuine

( bona fide).

pushbrk,

for the nth times, why do u really wanna insist on "the relationship" when in fact the uscis clearly wrote there "marriage"?

PLEASE READ POST #82 AGAIN SEE FOR YOURSELF WHAT USCIS WAS LOOKING FOR... IT CONTRADICTS ON WHAT YOU INSIST

THIS ONE IS A CONTEXT FROM USCIS >>>information and details explaining how the person acquired his or her knowledge of your marriage)

THIS ONE IS A CONTEXT FROM PUSHBRK >>> The affidavits should contain information about the relationship, not the wedding.

this is not to attack any of the posters, but to clarify... its just about adding to what was originally posted...

Evidence of the Relationship.

Submit copies of documents indicating that the marriage

upon which you were granted conditional status was entered

in ''good faith'' and was not for the purpose of circumventing

immigration laws. Submit copies of as many documents as

you wish to establish this fact and to demonstrate the

circumstances of the relationship from the date of the

marriage to the present date, and to demonstrate any

circumstances surrounding the end of the relationship, if it

has ended. The documents should cover, but not limited to,

the following examples:

1. Birth certificate(s) of child(ren) born to the marriage.

2. Lease or mortgage contracts showing joint occupancy

and/or ownership of your communal residence.

3. Financial records showing joint ownership of assets and

joint responsibility for liabilities, such as joint savings and

checking accounts, joint federal and state tax returns,

insurance policies that show the other spouse as the

beneficiary, joint utility bills, joint installments or other

loans.

4. Other documents you consider relevant to establish that

your marriage was not entered into in order to evade the

U.S. immigration laws.

5. Affidavits sworn to or affirmed by at least two people who

have known both of you since your conditional residence

was granted and have personal knowledge of your

marriage and relationship. (Such persons may be required

to testify before an immigration officer as to the

information contained in the affidavit.) The original

affidavit must be submitted and also contain the following

information regarding the person making the affidavit:

his or her full name and address; date and place of birth;

relationship to you or your spouse, if any; and full

information and complete details explaining how the

person acquired his or her knowledge. Affidavits must be

supported by other types of evidence listed above.

The witness didn't just attend the wedding, she actually presided the wedding being the judge, not a fake judge, that makes the marriage genuine. Another proof, if the wedding the judge presided was fake, then we wont be able to acquire a marriage certificate from NSO because fake marriages won't appear on NSO records.

I'm sorry ronyazi, but i'm not the one who doesn't understand them. I never said to make that affidavit as their guide, i posted it saying thats how my affidavit looked like and they keep on telling me that my affidavit's contents were not correct. How can anyone here say that the contents were wrong, nor they are correct. If they find it wrong and then i was approved, then they have to call the attention of the USCIS to why a wrong content of an affidavit had been approved.

i think it is wonderful that you provided examples of what you sent... i also think it is wonderful that your point of view is one that because you got married that its a bona fide marriage... you seem to have a very good heart... thats how it should be... i wish it were like that for everyone...

there are plenty of ppl that marry just to try to get a visa and dont see their spouse any more than they have to in order to file... that is what i think the USCIS is looking for when they look at affidavits...

i dont think anyone questions that your marriage is bona fide... or your motives... at least they shouldnt

perhaps what you sent was strong enough without your affidavits that it didnt matter...

again, i think what you posted is great as a base... ppl could just add information about what happened after the wedding up to the point of filing and it would be great
