Agreed your EAD will not be issued until your have replied to the RFE.... and your 90 days will restart from the date they recieve your RFE...

NOt sure if I agree.

My RFE touched on Feb 13 and I received the AP 2 weeks later and the EAD 3 weeks later.

I don't think the 90 days are counted from the RFE.

October 30, 2005 - Married in Vegas

December 27, 2005 - EAD, AP, AOS mailed

January 4, 2006 - received in Chicago

January 27, 2006 - RFE for medical received

February 13, 2006 - Medical received

February 15, 2006 - Biometrics appointment at 10 am

March 1, 2006 - AP touched

March 4, 2006 - AP received

March 8, 2006 - EAD received

March 29, 2006 - interview notice received - May 31, 2006

May 31, 2006 - Successful interview!!! Approved

June 12, 2006 - Green card received

Feb 28, 2008 - will be sending removal of conditions docs.

so unless the RFE letter specificaly says that the ead will be affected by the rfe then dont worry about it you will still be fine..

Well, my letter in fact DID specifically say that, and I'd be willing to bet yours did too.

The 90 day clock is "supposed" to be reset by the RFE. Now whether USCIS can sufficiently keep track of that so as to not issue interim EADs otherwise is apparently a different story.

We as well plan to try to get the interim EAD in an infopass appointment as well as soon as the 90 days have past. Yours and others' experiences have led me to believe that at USCIS one hand doesn't know what the other is doing.

Again, the 90 days is the time you must wait to apply for an INTERIM EAD. You returned your RFE (ie. your I-485 was "active" again") and you happened to have your EAD approved still within the original 90 day window.
