i'm thinking should i file i-130 and also send the visit visa papers to my mother, would that be a problem?

if visit visa is rejected for some reason then i still have my i-130 is going, the purpose is, i dont want to waste my time.

any advice?

What is your status? Are you a US Citizen??

NOTE: Your mother applies for a visitors visa, not you.

If she were to get the B-Visa, and did travel to the USA, she could adjust status IF you are a US Citizen. You would file I-130 and I-485 together AFTER she comes to the USA to USCIS Chicago.

i'm US citizen

let says i apply for i-130 and apply for visit visa and my mom got visit visa and she is in USA then i can apply 485 after i already filed i130? correct?

If you do, yes, you would in that case attach a copy of I-130 NOA1 or NOA2 letter to the I-485, showing a pending or approved I-130 that you would adjust status from.

Again it is your mother that is applying for a visitor's visa, not you, she is the one that fills out the DS-156 and files it to the US Consulate or US embassy.

But you cannot intentionally use the B2 visa as the entry "vehicle" on a preconcieved path to immigration...

Correct, I have read many cases where a parent came to the USA on a visitor's visa, and then after coming here they decide to adjust. That is why you file the I-130 and I-485 together AFTER they are here as a visitor.

Naturalization cert would be sent in with I-130 to prove citizenship, mother wont need that to get a visitors visa. You may send her an I-134 to show how she will be supported while she is visiting.

If you do file I-130+I-485 to adjust status later, you will be providing an I-864 with the AOS application.

thank you for the reply.

the reason i said i have to send my natz certificate along with i-134 is because my mother got denied the visitor visa last year and embassy folks said that you can try when your son got citizenship but i'm not sure by entering my name and other info do they know that i'm USC ?

i'm not sure

Sounds like she was just fed a line, unlikely to get a visitors visa.

Your become a USC has no impact on the likelyhood of success, actually you can argue the opposite.
