Hello,

We have been married for 2 years now. We finally got our interwiew at beginning of march. Everything seemed to be fine until the agent told us that the wrong date of birth was entered in the adjustment of status. Now, they have to do a check. When i check the case online it is now up to date.

How can i find out what is going on? the lawyer is not being much help and did not even apologize fir the error made!!

How long would the case be delayed? Can i contact a congressman?

I have seen cases where many people have made this type of error -for example putting current year for year of birth and mixing up month and date. All you can do is wait for an RFE - if you don't get one, then make sure you give them a corrected I485 at the time of the interview. Good Luck

I have seen cases where many people have made this type of error -for example putting current year for year of birth and mixing up month and date. All you can do is wait for an RFE - if you don't get one, then make sure you give them a corrected I485 at the time of the interview. Good Luck

Thank you for your reply but what is an RFE? i know the agent that interwiewed us corrected the error and he said he was sending the info the same day.

RFE is Request For Evidence but it does not apply in this situation. There is no set time for name checks per se other than it is not suppose to take longer than 180 days or something to that effect.

Personally, I was very involved with my case and I always proofread anything that went out from the lawyer's office. Ultimately, the real people who have a vested interest in your case are, in so many words: You both. Always proofread, review, correct and whatever else needs to be done before the lawyer ships it away.

Do you mean they had to check something specifically for the birth date, or could it be that you are still in the FBI name check?

Either way you might want to make an infopass appointment to find out more about it (you can also try the misinformation line).

My wife and I filed her paperwork on our own and made the mistake of the birth year as 2008. USCIS sent it back as "rejected" without giving the real reason. We had to dig to find out that it was the DOB. We lost about seven weeks, but now we are back on track.

Good luck moving forward.

I personnaly field in the applications but i did not know that the lawyer was doing it over!!!
