Heh we're both waiting on NOA1 for I-129F now :unsure:

They say they're working on Oct 07 I-129F filers but some Dec 07 filers or even Jan 08 seem to have been approved already so not sure what to expect :wacko:

Yeah! Husband just sent the I129F!

Hopefully we won't get any RFE!

I have noooooooo idea how Immigration works! I guess it's just luck!

Those timelines at the USCIS website mean nothing!

Well i just realized most January 08 who got approved actually sent their papers in Sept 07 but only got NOA1 in January 08 so the VJ timelines are all messed up now...and the USCIS times actually seem accurate...ugh

Also lately they have been approving both I-130 and I-129F on the same day so I wonder what timeline we should look at....the I-130 one or the I-129F.

I'm in the US right now (been here for 3 months) and going back to France for 3 months in 2 days :crying:

I'm gonna try to come back in August for 2 months but who knows if they'll let me through POE :wacko: sooooo frustrating !

Exactly. I have a friend here from Brasil who sent her I130 in December, got her noa1 in February. Also she sent her I129F in February and got her noa1 in March. Still no approval. It's weird because when you compare to other timelines, I see all those people from all over the world and their K3 has already been approved a loooong time ago. But for Brazil, it takes AGES! :angry:

I think they don't like Brazilians! They take sooooo long on our processes it's not even funny! We are goood people, you guys!! I promise! A liiiiiiittle very tiny lazy and party-animal people, but hard workers! :whistle:

I just hope that the California SC has hired new people and started working properly and faster. I can't take 10 months away from my honey! I've heard that the USCIS is under funded, understaffed, and under trained, this is why everything takes sooo long.

I just want and need the approval ASAP. :thumbs:

Yeah, yeah, no wonder the timelines are all messed up.

If you sent the I129F you should look to that. If your I129F is approved before or on the same day that your I130, then you are a K3. The approval of the I129F actually decides everything. If your I129F is approved before or simultaneously with your I130, they don't process your I130 and you can go to the USA as a K3 Visa holder.

If your I130F is approved before your I129F, they "cancel" your I129F and you have to wait for the approval of the I130. This hasn't happened much, because the USCIS are trying to pass the job forward to the NVC's... lol... so they approve everything on the same day, so that it becomes a NVC problem. Get it?

Hey, you should be content, because at least you can stay with your chérie. I can't even do that. The last time I saw him was on the 2nd. February. He can't come down here until October (work issues).

Mais c'est la vie! Argh, je ne sais au juste.

Well your friend you was talking about is probly still considered a december filer so he should get approval soon...

I cant really be with my "Cheri" cause I'm leaving him tomorrow to go back home :crying: I don't know if i'll be able to come back at all...and he can't come to me :crying:

What about you? You cant go visit him ?

Oh, I am sorry to hear that. My husband can't come soon either. He works a lot and cannot take a vacation any time he wants. :crying:

I cannot enter the USA while we are petitioning for a K3. I don't have a valid tourist Visa and cannot request to renew my old one (was due until 2007) because I am waiting for my K3.

The only choice we have is for him to visit me.... nooooo idea when!

Hello!!! I filed in the end of March, so I consider myself an April filer too... Im very nervous about this visa taking a year because I´ve read stories of July 2007 filers who still don´t have their visas. This waiting time is horrible!!! I still haven´t received the I-129F NOA1 and this is driving me nuts!

By the way, im in a very similar situation as yours... I can only see him when he comes here and he cant come and go often because of work and travel expenses... :(

Hi Monica! Finally a brasileeeira around here!

Welcome to the K3 journey!

I've heard about a lot of people that are still waiting for their July petition. On the other hand, I hear also a lot about people who petitioned in September and were approved in January, people who have petitioned in December and are now being approved. Most of them from other countries other than Brazil!

I am reaaally starting to think that they despise brazilians for some reason and for that it takes much much longer to allow us to enter the USA. Another point is, and I guess you can check it on the USCIS website, the USCIS has received aaaaa lot more VISA processes in July 2007 than any other year all together. They are delayed because of that. Now that they are processing the October 2007 processes, that means that they are passed that JULY rush. I guess. lol :blink:

I am hoping and praying that my visa get's approved latest in October. Another 2 months to my interview and I could try an be with my husband by Christmas. Actually, to have the right to live with my husband and spend a Christmas with him. Come on, how insane is that? :( You love somebody, marries that somebody and cannot live with your loved one? Craaazy!

Also, after a looong discussion with other brazilian women who are on the line too, we have come to a conclusion: YOU CAN ONLY COUNT ON YOUR LUCK HERE. I mean, while you are petitioning for a visa. Some get approved first, some are held back... there's no way to know. You can only hope that you are lucky enough.

I am also exactly like you. My husband works his as* off to earn some money and can't come here all the time. We all have expenses and it's very hard for him to come every 3 months like other people do.

Well, let's have some reality check and go back to the I129F NOA1 waiting line, right? lol :bonk:

What better Xmas present really? To finally be with ur hubby forever....that would be awesome i think when i got my visa in hand I'll :crying: lol But I kinda imagine I wont get mine till around February 2009 (thats our wedding anniversary :blush: )

About some countries taking longer to get approved...I got confirmation from my lawyer that it really does depend where u come from...he said one of his client was from Haiti and got approved in 3 months with CSC. He said it depends a lot on the relationship of that country with the US but couldnt tell me about France or Brazil :wacko:

Do u guys have a lawyer as well? I wonder if it really makes a difference...

Nice to hear from you again! My husband's bday is in November - but we have even discarted speding Thanks Giving togethere. We are trying to be positive and praying that we will be together for Christmas. I do not want to spend another Xmas without him. I couldn't possibly stand that.

Sometime reality comes along and the thought of having my visa only in Feb 2009 comes along... it scares the hell out of me. NO! Our first wedding annivesary appart (married in Jan)? Hell NO!

I definetely know that it all depends from where you come from. People from Russia, Philipines and wherever else got approved and sent the I130 in October! Commeee ooooon!

For you to realize how they are here, a friend of mine who's pregnant, had to do a DNA exam before her interview in order to prove that the baby is from the USC. Unbelievable! hahahaha

This may help you guess or anticipate when USCIS will get to your petition and approve it.

You should have a K-3 prioritization date, which should basically be the date they physically received your first petition (I-130).

This is the date you want to pay attention to when determining when they will look at your petition and approve it. This is ASSUMING there are no RFE, complications, mistakes or incorrect information. Many things can cause delays, but we will hope that is not the case.

The NOA1 receipt dates do not really play in prioritizing first in / first out.

The USCIS time line is fairly general, but can give you an idea. If you want to look at VJ Time Lines, then look at the I-130 sent date for comparison. Also, keep in mind that not all VJ members are updating there time lines regularly.

Altough nothing is written in stone, this is a good guideline to go by.

I hope this helps and I wish everyone a rapid journey.
