Hello Everyone,

Just wondering about this...... In the I-134 directions, the requirements don't state anything about Paystubs. They only mention a letter from the employer, bank account letters etc.

I wanted to know whether I need to submit by stubs? The reason is that my W-4 states that I am married because I am anticipating getting married before I file next year's taxes.

Do I need to send them the stubs or can I just send them a letter from my employer along with all my bank account information?

I would submit pay stubs as well, just in case. You never know what they will want. You don't want to be stuck in a situation where they ask for them and you don't have them there. I would submit them just to be on the safe side.

1/20/07 - MARRIED!!!!!

2/10/07 - rec'd certified copy of marriage license

3/13/07 - AOS package rec'd at Chicago Lockbox

3/20/07 - Rec'd Social Security Card

3/21/07 - Checks Cashed and Case Status online

3/24/07 - NOA1 Rec'd for AOS and EAD

3/27/07 - rec'd Biometrics appt letter - scheduled for 4/20/07 @ 11:00am

4/02/07 - "touched"

4/20/07 - had biometrics appt.

4/21/07 - rec'd letter stating case was transferred to CSC

5/22/07 - rec'd Case Pending at CSC email

6/25/07 - EAD card production ordered

7/7/07 - EAD "touched"

7/7/07 - AOS "touched"

8-6-07 - Rec'd EAD Card in the Mail

5-20-08 - AOS INTERVIEW - APPROVED - PASSPORT STAMPED

7-2-10 - Received 10 year green card in mail

We submitted a couple of pay-stubs, they did not look at them though, but its good for your peace of mind!

They dont actually ask for pay stubs just the letter from your employer but if you feel better sending them then do so :)

Your best bet would be to link up with some other India members on VisaJourney (i.e. timeline search and personal maessage some or post in the regional forum). I've heard of many different consulates requesting different forms of evidence to help support the I-134 Affidavit of Support. In our case, the US Consulate in Ho Chi Minh City, Vietnam likes to see 3 to 5 recent pay-stubs. However, this may not be the case in India. More specific consulate/embassy advice will be good for you.

Recognize that the I-134 is not the full financial documentation that may be required by a consulate to determine that the visa applicant meets the public charge provisions of the law. Pay stubs are commonly submitted by sponsors as additional evidence, but that is not to say that they are required. What's required is sufficient evidence, 'sufficienct' being at the discretion of the consular officer handling the case, and you have flexibility in deciding what evidence you chose to provide. Note, however, that if the consular officer reviews what you have chosen to provide and then asks for pay stubs it's probably a good idea to provide them if you want the visa to be issued.

What one declares on their W-4 does not need to match their actual situation. W-4 is simply a means to determine an appropriate level of withholding and if using a marital status that is different from your actual status produces the desired result then do so.
