Hi everybody,

My sister in law is under K-1 status, applied for AOS already, did biometric. Last week i took her to the DMV so she could take the test for driver license. The DMV people said they cannot let her take the written test because her I-94 expired. We only have the form I-797C. Would that work for the driver license or id card? ANybody knows please help me. Thank you very much.

If you're applying in CA, it would not work. I tried that before while I was waiting for the green card. It has to be the green card or EAD.

i am in arizona and was thinking to go to DMV with the NOAs recipts ,but i think they will ask about the EAD or green card.

We just showed AZ DMV my wifes passport with visa & they issued her an I D for the same time frame as the visa.

That's because you have a K3 visa. Those who came in on a K1 will generally need either an EAD or a GC to be able to get a driver's license.

08/17/08: Mailed N400 to TSC

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

Just take your birth certificate , passport with you ... all originals and one utitlity bill as address proof.... You will get the Identification card

Feb 1,2007 - I-130 Reached USCIS.

Feb 4,2007 - I-130 accepted > Get USCIS case Number NOA1.

May 8 ,2007- GET NVC Case Number > NOA2.

June 16 ,2007- Get Order from NVC to pay 70$.

July 2 ,2007- Get DS-3032 in India.

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1

We're talking about the sister-in-law with a K-1 visa, and residing in CA, correct?

You may try your luck but I wouldn't be surprised if they wouldn't honor the application..

Please get back to us if your sis-in-law is able to secure her CA ID with only the documents stated above.

"What is an Acceptable Document?

An acceptable birth date/legal presence or true full name document is one produced by an issuing authority such as a county, state, or federal agency. The document is a certified copy of the original (the original is always retained by the issuing authority) and will contain an impressed seal or an original stamped impression. The certified copy will be given to you. If you make a copy of the certified copy, DMV will not accept it for birth date/legal presence or true full name verification.

What is a True Full Name?

Your true full name appears on your BD/LP document. If you change your name, then you must provide one of the following documents to verify your name change:

Adoption documents that contain the legal name as a result of the adoption.

A name change document that contains the legal name both before and after the name change.

Marriage certificate (issued from a local or state Office of Vital Statistics).

A certificate, declaration, or registration document verifying the formation of a domestic partnership.

Dissolution of marriage document that contains the legal name as a result of the court action.

A completed Medical Information Authorization form (DL 328) in conjunction with a gender change.

This document must be issued by a government agency within the United States or a foreign jurisdiction that is authorized to issue such documents. The document must be a legible and unaltered original or certified copy with a government seal, stamp or other official imprint. You will need to surrender your current driver license and/or ID card.

What are the Requirements for a Name Change Document?

The name change document must be:

Provided by an authorized US governmental agency or foreign jurisdiction.

To get an Identification card or a drivers license, you have to have your social security number, I had to here in Rhode Island. I also had to show a utility bill, green card and marriage license I think as well. Check out your areas DMV website.

11/10/08 - Removing Conditions - Sent package out!

11/19/08 - Received Notice of Action - 1 year extension on my current green card - now waiting for biometrics letter.

11/28/08 - Received biometrics letter.

12/12/08 - Biometrics appointment - 10am.

01/13/09 - Still waiting............

06/08/09 - Card in production and on it's way!

06/22/09 - Received 10 Year Green Card! YAY!!

It seems that CA's requirements are pretty clear. They are like OKlahoma --- no EAD or no green card, no license or state ID for you, K-1 grasshopper!
